   347                               March Court 1717
   by his certain writing obligatory which he the Said Deft~. Sealed -
   with his Seale and as his deed delivered hereinto Court brought the
   date whereof is the Same day & Year afd Granted himselfe holden
   and firmly bounden to the afd Plt. in the afd full & Just Sume of Eighteen
   pounds ten Shillings Currant money of ye afd Province to be paid to
   the Said Plt. when thereunto required Yet the afd Deft~ altho’ often
   required the afd Eighteen pounds ten Shillings to the afd Plt. hath
   not paid but that to pay the Said Deft~ hitherto hath denied & Yet
   denys to ye damage of the Said Plt five pounds Currant money afd
   & thereupon he brings Sute &ca.                                             Jno Doe

   And the Said Deft being Called came And the Said Plt by his attry afd
   Prays that the Said Deft~ may give Special baile to the afd Accon—
   which is granted And that he be kept in Safe Custody by the Sherf
   of Said County untill he Shall give Special baile as afd After which
   comes into Court John Caisly of Said County and Acknowledges himselfe
   as Special baile in the afd Accon (that is to Say) He doth undertake for the
   afd Deft~ the payment of the debt afd and Cost thereon Accruing if the Sd
   Plt Shall obtaine Judgment against the Said Deft in the afd Accon
   of Debt and the Said Deft the Condemnation Shall not Satisfie nor
   himselfe to the Custody of the Sherf of Said County deliver or that~
   the afd John Caisly the body of the afd Deft Shall not render &ca.
   Rule is by the Court to the Said Deft given that He plead the Twentieth
   day of ye Month in the morning otherwise Judgment to be rendered .
   for want of the Same . .   And the Said Deft by John Johnson
   his attry appeared to the above Accõn   After which the Said Deft~
   comes into Court and Saith that he Cannot gainsay ye Accon afd of
   him the Said Plt~ nor but that the writing obligatory above mentioned
   is his Act and deed and is willing that Judgment Should be entered
   for the Same Sume above mentioned and Cost thereon Accruing provided
   the Plt will release the Penalty of the above mentioned obligation =
   Therefore it is Considered by the Court here vizt. this Twentieth day of
   March Anno Domini One Thousand Seven hundred and Seventeen That the
   Said Plt. William Frisby do recover against the Said Deft John Moll as
   well the afd Sume of Eighteen pounds tenn Shillings Currant money Debt
   as also the Sume of ffour hundred and nine pounds of Tobacco Cost by the
   afd Plt~ about his Sute in this behalfe Expended and by the Court here of-
   his assent adjudged And the Said Deft in mercy

   And the afd Plt~ comes into Court relinqueshes the Penalty of the above
   obligation in the Judgment afd being Nine pounds five Shillings
