   345                                March Court 1717
   that he render to him ye Sum of four hundred & Seventy pounds of—
   Merchantable leafe Tobacco of the value of Sixty Shillings Sterling money
   which he unjustly detains &ca. And that he have then and there the
   Said writ &ca. Att which Said next Court vizt the Eighteenth day—
   of March the Same year last mentioned the day of return of Said
   writ Came Simon Wilmer Gent~ high Sherf of Said County and
   made return thereof in these words thereon endorsed as followeth
   vizt. Cepi Corpus pr Simon Wilmer Sherf
   And A Decln being fild when Said writ Issued forth and a -
   Copy thereof Served therewith According to Act of Assembly in—
   Such Case made was as folls vizt. Kent County Ss William Thornton
   of Kent County Planter alis Dics William Thornton of Kent County
   in ye Province of Maryland Gent was Summoned to Answer unto
   Henry Hendrickson of Cecil County in ye afd Province Planter of~
   a plea that he render to him ye Sum of four hundred & Seventy
   ounds of Merchantable leafe Tobacco of ye value of Sixty Shillings
   Sterling money which he unjustly detains &ca. And whereupon—
   the afd Plt. by Thomas Bowne his attry Saith that wereas the
   afd Deft~ the eight day of May Anno Domini Seventeen hundred
   and thirteen at St. Pauls Parish in Kent County afd within the
   Jurisdiciõn of this Court by his certain Bill obligatory which he ye
   Said Deft~ Sealed with his Seale and as his deed delivered hereinto
   Court brought the date whereof is the Same day and Year afd granted
   himselfe to owe and Stand indebted to the Said Plt. the afd Sume
   of four hundred and Seventy pounds of Merchantable leafe Tobacco
   of the afd value of Sixty Shillings Sterling money to be paid to the
   Said Plt. when thereunto required Yet the afd Deft altho often required
   the afd four hundred & Seventy pounds of Tobacco to the Said Plt hath
   not rendered but that to render or pay the Said Deft hitherto hath
   denied and Yet denys and unjustly detains to the damage of the Said
   Plt. one hundred and Twenty Shillings Sterling money and thereupon
   he brings Sute &ca.   TBowne pr Querr Pls &ca. Jno Doe & Richd Roe -
   And the afd Deft~ in his proper person appeared to the above Accon and
   Saith that he Cannot gainsay the Accõn afd of him the Said Plt nor
   but that the writing obligatory above mentioned is his Act and deed
   and that he oweth unto the afd Plt the afd Sume of four hundred and Seventy
   pounds of Tobacco and is willing that Judgment Should be entered for
   the Same and Cost thereon accruing = Therefore it is Considered
   by the Court here vizt. this Twentieth day of March Annoqe Domini one
