   341                                       March Court 1717
   John Brown . | Commanded it was to the Sherf of Kent County the Twenty
           at | third day of November in the Second Year of his Lord Ships
   John Heathcott | Dominion &ca. That he take John Heathcot of Kent County
   ~~~~~~~~~~ | Planter alis Dics John Heathcot of Kent County Planter if
   he Should be found in his Bailywick and him Safe keep So that he have
   his body before his Said Lord Ships Justices of the next Court to be held at~
   our Court house in the Town of Chester in Said County to Answer unto John—
   Brown of Said County Planter of a plea that he render to him the full and Just
   Sum or Quantity of five hundred pounds of good Sound Merchantable leafe
   Tobacco Clear from Ground leaves and all manner of Trash and Cask to Contain
   the Same of ye price and value of four pounds Sterling which from him he
   unjustly detains &ca. . And that he have then and there the Said writ &ca.
   Att which Said next Court vizt. the Eighteenth day of March the Same
   year last mentioned the day of return of Said writ came Simon Wilmer
   Gent~. high Sherf of Said County and made return thereof in these words.
   thereon Endorsed as folls vizt. Non Est Inventus pr Simon Wilmer Sherf
   And A Decln being fild when Said writ Issued and a Copy thereof Expressing
   the true cause of Accõn left at the last place of the Defts abode According
   to Act of assembly in Such Case made was as folls vizt. Kent County Ss John—
   Heathcot of Kent County Planter alis Dics John Heathcot of Kent County —
   Planter was Summoned to Answer unto John Brown of the Said County
   Planter of a plea that he render to him the full and Just Sum or Quantity
   of five hundred pounds of good Sound Merchantable leafe Tobacco Clear —
   from Ground leaves and all manner of trash and Cask to Contain the Same
   of ye price and value of four pounds Sterling which from him he unjustly.
   detains &ca— And Whereupon the afd Plt. by Thomas Bowne his attry
   Saith that whereas the afd Deft~ the thirtieth day of October in the Year
   of our Lord Christ one Thousand Seven hundred & Seventeen at St. Pauls
   Parish in Kent County within the Jurisdiciõn of this Court by his Certain—
   writing obligatory which he the Said Deft Sealed with his Seale and as
   his deed delivered hereinto Court brought the date whereof is the Same day
   and Year afd granted himselfe holden and firmly bound unto the afd Plt~ in the
   afd full and Just Sum or quantity of five hundred pounds of good Sound Merchant:
  :able leafe Tobacco clear of ground leaves & all manner of Trash & Cask to —
   Contain ye Same of the afd valueof four pounds Sterling to be paid to the afd
   Plt. when thereunto required Nevertheless the afd Deft~. altho’ often required
   the afd Summe of five hundred pounds of Tobacco to the afd Plt~ hath not~
   paid but that to him to render or pay hath altogether denied and Still doth
   deny & unjustly detain to the damage of him the afd Plt. Eight pounds —
   Sterling money and thereupon he brings Sute &ca. TBowne pr Querr pls Jno&Doe
