                                       March Court 1717                                     340 
   last mentioned the day of return of Said Writ Came Simon Wilmer Gent~
   high Sherf of Said County and made return thereof in these words——
   thereon Endorsed as folls vizt Cepi Corpus pr Simon Wilmer Sherf
   And A Decln being fild and a Copy thereof Sent to be Served on the Said
   Deft~. &ca. the Decln as folls vizt. Maryland Kent County Ss Robert Mackey
   late of Kent County Planter als Dics Robt. Mackey of Kent County was —
   Summoned to Answer unto Richard Gough of a plea that he render unto him
   the full & just Sum of Six hundred pounds of good Sound Merchantable leafe
   Tobo. of the value of five pounds Stelring money of Great Brittaine wch. from
   him he unjustly detains &ca. And Whereupon the afd Deft the fifteenth day
   of June in the Year of our Lord one Thousand Seven hundred & Sixteen at~
   the Parish of Shrewsbury in the County afd & within the Jurisdiciõn of this
   Court by his Certain bill or writing obligatory Sealed with his Seale &
   hereinto Court brought whose date is the Same day and year afd did Ac:
  :knowledge himselfe to be holden unto the Said Plt in the Said Sum of
   Six hundred pounds of good Sound Merchantable leafe Tobo. of the value in—
   Caske to Contain the Same Convenient in Sarsafrax River to be paid to the Said
   Plt when he Should be thereunto required Nevertheless the afd Deft altho’
   often Required the Said Sum of Six hundred pounds of Tobacco of the
   value of the afd five pounds Sterlg money of great Brittaine to the Said Plt~
   hath not rendered or paid but to render or pay hath hitherto gainsayed &
   Still doth gainsay to the damage of the Said Plt tenn pounds Sterlg and
   thereupon he brings Sute &ca. Johnson pr Plt~. pls. Jno Doe Rd Roe ——
   And the Said Deft came into Court and in his proper person Appeared to
   the above Accon And Saith that he Cannot gainsay the Accõn of him~
   the Said Plt. nor but that the bill obligatory above mentioned is his
   Act and deed and that he oweth unto the afd Plt. the afd Sume
   of Six hundred pounds of Tobacco and is willing that Judgment~
   Should be Entred for the Same and Cost thereon Accruing : Therefore it
   is Considered by the Court here vizt. this Twentieth day of March——
   Annoque Domini One Thousand Seven hundred and Seven——
  :teen That the afd Plt Richard Gough do recover against the Said —
   Deft Robert Mackey as well the afd Sume of Six hundred pounds
   of Tobacco Debt as also the Sume of Two hundred and fifty :
   five pounds of Tobacco Cost by the afd Plt about his Suite in——
   this behalfe Expended and by the Court of here of his assent—
   adjudged and the Said Deft~ in mercy
