Bailywick and him Safe keep So that he have his body before his Said Lord Ships Justices of the next Court to be held at our Court house in the Town of Chester in Said County to Answer unto Richard Tilghman Esqr. of a plea yt. he render unto him the full and Just Sum of one Thousand three hundred Eighty and Two pounds of good Sound Merchantable Leafe Tobacco clear of all manner of trash & ground leaves with Cask to Contain the Same of the value of fifteen pounds Currant Silver money of Mary land afd which from him he unjustly detains &ca. And that he have then and there the Said writ &ca. . Att which Said next Court vizt. the Eighteenth day of March the Same Year afd the day of return of Said writ Came Simon Wilmer Gent~. high Sherf. of Said County and made return thereof in these words thereon Endorsed as folls vizt. Cepi Corpus pr Simon Wilmer Sher And A Decln being fild when Said writ Issued forth and a Copy thereof Served therewith According to Act of Assenbly in Such Case made was as folls vizt. Maryland Kent County Ss Daniell Whalley of Kent~ County Planter otherwise called Daniell Whalley of Queen Ann’s County . planter was Summoned to Answer unto Richard Tilghman Esqr. of a plea yt. he render unto him the full and Just Sum of One Thousand three hundred Eighty and two pounds of good Sound Merchantable leaf Tobacco clear of all manner of trash & ground leaves with Cask to Contain the Same of the value of fifteen pounds Currant Silver money of Maryland afd which~ from him he unjustly detains &ca. And Whereupon the Same Richard Tilghman by James Earle his attry Says that Whereas the afd Daniel the thirtieth day of July Anno Domi one Thousand Seven hundred and Eleven at Chester old Town in Kent County afd and within the Jurisdiciõn of this Court by his Certain bill obligatory with the Seale of him the Said Daniel Sealed acknowled himselfe to owe & Stand indebted to the afd Richd in the afd Sume of One Thousand three hundred Eighty and two pounds of Tobo. qualified & Conditioned as afd in Cask as afd to be paid to ye Same Richard Convenient at Chester River in Queen Ann’s County on or before the tenth day of October next Ensuing the afd thirtieth day of July in the year Seventeen hundred and Eleven afd & for ye performance thereof the afd Daniel did bind himselfe his heires Executors and Administrators firmly by the Same bill Nevertheless the afd Danl.
