   337                                    March Court 1717
   Jurisdiciõn of this Court by his certain bill obligatory which he the Said
   Deft: Sealed with his Seale and as his deed delivered here into Court brought
   the date whereof is the Same day and year afd bound himselfe his heires
   &ca. to pay or cause to be paid unto the afd Plt the afd Sume of fieve
   hundred and fifty pds of Good Mercht.able Tobo of the afd price and value
   of five pounds Sterlg money at or upon all demands after the date of—
   the Said Bill obligatory Yet the afd Deft altho’ often required the
   afd Sume of five hundred and fifty pounds of Tobacco to the afd Plt~
   hath not paid or cause to be paid but that to him to render or pay hath
   hitherto denied and Still doth deny and unjustly detaine to ye damage
   of him the Said Plt. Tenn pounds Sterling money and thereupon—
   he brings Sute &ca TBowne pr Querr pls &ca. Jno Doe & Richd Roe
   And the Said Deft~. being called came And the Said Plt by his afd attry
   prays that the Said Deft may give Special baile to the afd Accõn which
   was granted. After which Charles Hynson and Samuel Gooding both~
   of this county comes into Court and Acknowledges themselves Joyntly and
   Severally as Special baile in the afd Accon (that is to Say. they and either of
   them do undertake for the Said Deft~ the payment of the Debt afd and.
   Cost thereon accruing if in case the Said Plt. Shall obtaine Judgment~
   in the Said Accõn of Debt. And the Said Deft the Condemnation Shall
   not Satisfie nor himselfe to the Custody of the Sherf of Said County deliver
   or that the afd Charles Hynson and Samuel Gooding or either of them~
   the body of the Said Michael Shall not render &ca.
    After which the afd Deft in his proper person appears to the above
   Accõn and Saith that he Cannot gainsay the accõn afd of him the Said
   Plt. nor but that the writing obligatory above mentioned is his Act &
   deed and is willing that Judgment Should be entered for the Same and
   Cost thereon Accruing=   Therefore it is Considered by the Court here
   vizt. this Twentieth day of March Annoq~ Domini One Thousand Seven~
   hundred and Seventeen That the afd Plt James Cruckshanks do recover
   against the Said Deft~ Michael Byrne as well the afd Sume of five—
   hundred and fifty pounds of Tobacco Debt as also the Sume of Three hundred
   and Seven pounds of Tobacco Cost by the afd Plt. about his Sute in this behalfe
   Expended and by the Court here of his assent adjudged and the Said Deft
   in mercy                                                                             —Jams Smith Clk
