March Court 1717 330 Cask to Contain the Same of the price and value of Six pounds Sterling money which from him unjustly detains &ca. . And Whereupon the afd Plt. by Thomas Bowne his attry Saith that Whereas the afd Deft~ the twentieth day of March in the year of our Lord Christ one Thousand Seven hundred & Sixteen at St. Pauls Parish in Kent County within the Juris: :diciõn of this Court by his certain bill obligatory which he the Said — Deft~ Seald with his Seale and as his deed delivered hereinto Court~. brought the date whereof is the Same day & Year afd bound himselfe his heires Exrs. & Admrs. to pay or cause to be paid unto the afd Plt. the afd full Summe & Just Quantity of Six hundred Eighty & three pounds of good Sound Merchantable leafe Tobacco Clean & Clear of all manner of trach & Ground leafs in Cask to Contain the Same of the afd price & value of Six pounds Sterling money Convenient in Kent County . abovesaid at upon or before the tenth day of November next Ensuing the date of the Said Bill obligatory Yet the afd Deft altho’ often— required the afd Sume of Six hundred Eighty three pounds of Tobo. to the Said Plt. hath not but that to him to render or pay the Said — Deft~ hitherto hath denied and Still doth denie & unjustly detaine to the damage of him the Said Plt. Twelve pounds Sterling money and thereupon he brings Sute &ca. TBowne pr Querr pls &ca. Jno Doe & Rd Roe And the Said Deft~ being called came and the Said Plt by his afd attry prays that the Said Deft might give Special baile to the afd Accon which was granted And that he be kept in Safe Custody by the Sherf of Said County untill he Shall give Special baile as afd After which came the afd Deft againe into Court and Saith that he Cannot gainsay the accõn afd of him the Said Plt. nor but that the bill obligatory above mentioned is his Act and deed and that he oweth unto the afd Plt the afd Sume of Six hundred Eighty three pounds of~ Tobacco and is willing that Judgment Should be entered for the Same & Cost thereon accruing Therefore it is Considered by the Court here viz this - Twentieth day of March Anno Domini one Thousand Seven hundred & Seventeen That the afd Plt William Glanvill do recover against the Said Deft Josiah Crouch as well the afd Sume of Six hundred Eighty and . three pounds of Tobacco Debt afd as also the Sume of Three hundred and nine pounds of Tobacco Cost by the afd Plt. about his Sute in this behalfe Expended and by the Court here of his assent adjudged and the Said Deft~ in mercy &ca ——— —Jams Smith Clk |
