March Court 1717 328 Province aforesd. if he Shold be found in his Bailywick and him Safe keep So that he have his body before his Said Lord Ships Justices of the next Court to be held at our Court house in the Town of Chester in Said County to Answer unto William Frisby of a plea that he render him the full and Just Sume of Three Thousand eight hundred Sixty eight pounds of every way well qauli: :fied Tobacco in well Seasoned Cask of the price and value of thirty eight~ pounds Sterling money which from him unjustly detains &ca. And that he have then and there the Said writ &ca. Att which Said next Court vizt. the Eighteenth day of March the Same Year last mentioned the day of return of Said writ came Simon Wilmer Gent. high Sherf of Said County and made return thereof in these words thereon endorsed as folls- vizt. Cepi Corpus pr S: Wilmer Sherf. . And A Decln being fild when Said writ Issued forth and a Copy thereof Served therewith according to Act of Assembly in Such Case made was as folls vizt. Kent County Ss. Josiah Crouch of Kent County Planter alis Dics Jos. Crouch of Kent Coty & Province afforesd. was Summoned to Answer unto William Frisby — of a plea that he render him the full and just Sume of Three Thousand Eight hundred Sixty Eight pounds of every way well qualified Tobacco in well Seasoned Cask of the price and value of thirty Eight pounds Sterling money which from him unjustly detains &ca. And Whereupon the afd Plt. by Thomas Bowne his attry Saith that Whereas the afd Deft~ the fifth day of May in the Year of our Lord Christ one Thousand Seven hundred & Seventeen at St. Pauls Parish in Kent County within the Jurisdiciõn~ of this Court by his Certain writing obligatory which he the Said Deft~ Sealed with his Seale and as his deed delivered here into Court brought the date whereof is the Same day & Year afd granted himself his heires Exrs. & Admrs. holden and firmly bound unto the afd Plt~ in the afd full & just Sume of Three Thousand eight hundred Sixty Eight pounds of every way well qualified Tobacco in well Seasoned Cask of the afd price and value of thirty Eight pounds Sterling money to be paid to the afd Plt in Some Convenient place in the Said County when thereunto required Yet the afd Deft altho’ often required the afd Sume of Three Thousand Eight hundred Sixty & Eight pounds of Tobacco to the Said Plt hath not paid but that to him to render or pay^hathhitherto denied & Still doth denie & unjustly detain to the damage of him the Said Plt~. Seventy pounds Sterling money and thereupon he brings Sute &ca. . .
