   327                             March Court 1717
   Summe of ffour hundred and Seventy Six pounds of Merchantable
   Tobacco unto the afd Plt. when thereunto required would well and -
   truly pay & Content~ Nevertheless the afd Deft~. his promises and
   assumptions afd litle regarding but plotting & fraudulently Intending
   him the Said Plt. in that behalfe to deceive and defraud the .
   afd Severall Sums of Tobacco which in the whole amounts unto
   the [illegible] of nine hundred & fifty two pounds of Tobacco or
   any part thereof at or before the afd last mentioned Tenth day of~
   November in the Year of our Lord Christ one Thousand Seven hundred
   and Seventeen or from thence hitherto to the Said Plt hath not
   paid altho to do the Said Deft~ afterwards vizt. the afd Tenth day
   of November in the Year of our Lord Christ Seventeen hundred and
   Seventeen at the Parish County & Jurisdiciõn by the Said Plt was
   thereunto required but that to pay the Said Deft hitherto hath
   denied and Still doth denie to the damage of him the Said Plt.
   one Thousand pounds of like Tobacco afd and thereupon he
   brings Sute &ca.    TBowne pr Querr pls. &ca. Jno Doe & Richd Roe—
   And the afd Deft. came into Court and in his proper person—
   appeared to the afd Accõn and Saith that he cannot gainsay
   the Accõn afd of him the Said Plt. nor but that he is indebted
   the Sume of ffour hundred Seventy Six pounds of Tobacco in ye.
   afd Decln. mentioned and is willing that Judgment Should be—
   entered for the Same and Cost thereon Accruing: Therefore it-
   is Considered by the Court here vizt. This Twentieth day of March
   Anno Domini One Thousand Seven hundred and Seventeen#&151
   That the afd Plt. William Frisby do recover against the Said
   Deft~ John Mading as well the afd Sume of ffour hundred and
   Seventy Six pounds of Tobacco Damages on Accot~. of the Said —
   Deft his not performing his promise and Assumption afd as -
   also the Sume of Three hundred and Twenty pounds of Tobacco
   Cost by the afd Plt. about his Sute in this behalfe Expended and—
   by the Court here of his assent adjudged And the Said Deft~ in-
   mercy &ca ———                                          Jams Smith Clk~

             at | twenty third day of March in the Second year of his Lord
