March Court 1717 322 Christ one Thousand Seven hundred and Seventeen at St. Pauls — Parish in Kent County within the Jurisdiciõn of thie Court at the Speciall instance and request of the afd Deft~ had then and there Sold & delivered unto the afd Deft and to the proper use and behoofe of the Deft divers goods and Merchandizes in an Accot. hereunto Annexed Sett forth and at the like Special Instance and request of the Said Deft and to the proper use and behoofe had given Credit to a Certain Sarah Byrne— which in the whole Amounts unto the Sume of Seventeen—— hundred and Twenty three pounds of Merchantable Tobacco upon himselfe assumed and to the Said Plts then and there faithfully promised that he the Said Deft the afd Sume of Seventeen hundred and Twenty Three pounds of Merchantable Tobacco to the Said Plts when~ thereunto required would well and truly pay and Content And that~ whereas also the afd Deft afterwards vizt the afd Twenty eight day of September in the Year afd at the Parish County and Jurisdicion afd In Consideration that the afd Plts at the like Special instance & request of the afd Deft~. had then and there last mentioned Sold and delivered to the afd Deft~ and to the proper use and behoofe of the afd Deft~ and had give Creditt to a certain Sarah Byrne divers Goods & Merchandizes in an Accot~. hereunto Annexd Specifically Sett forth upon himselfe Assumed and to the Said Plts then and there last~ mentioned faithfully promised that he the Said Deft So much Merchan: :table Tobacco as the afd Goods and Merchandizes Sold and delivered as afd at the time of the Sale and delivery thereof reasonably were worth and Amounted to and the afd Creditt given as afd unto the Said Plts. would well and truly pay & Content and the afd Plts in deed Saith that the afd Goods & Merchandizes Sold & delivered as afd at the time of the Sale and delivery thereof at reasonable rates & prices and the Creditt given as last mentioned reasonably were worth & amounted unto the Sume of Seventeen hundred & Twenty Three pounds of Merchantable Tobacco in Manner and form as in the Said Accot Sett forth of which the afd Deft~ by the afd Plts then and there last Mentioned had Notice — Nevertheless the afd Deft his Severall Promises and assumptions - afd in form afd made litle regarding but fraudulently Intending them— the Said Plts in that behalfe to deceive and defraud the afd Severall Sumes of Tobacco in the whole Amounting unto the Sume of Three— Thousand four hundred and forty Six pounds to the Said Plts or to any of them hath not paid nor made Content for the Same altho that to do he the Said Deft the Eighteenth day of October in the Year afd at the parish |
