   321                                    March Court 1717
   be kept in Safe Custody by the Sherf of Said County untill he Shall give Special
   baile as afd . .    After which Ebenezar Blackiston of Said County here in
   Court came and Acknowledged himselfe Special baile in the afd Accõn
   and undertooke for the said Deft~ the payment of the Debt afd and Cost
   thereon Accruing if it Should happen that the Said Plt Shall—
   obtain Judgment against the Said Deft in the Said Accõn of Debt~
   and the Deft~ the Condemnation afd Shall not Satisfie nor himselfe
   to the Custody of the Sherf of Said County deliver or that the afds Ebenezr.
   Blackiston the body of the Said Deft~ Shall not render &ca ——
   And the Said Deft in his proper person appeared to the above
   Accõn and prayd liberty thereof to imparle thereto and to .
   answerat next Court which is granted the Same day is given—
   the Plt in like manner
    Rule is given by the Court that the Said Deft~ plead to the afd —
   Accõn twenty days before next Court otherwise Judgment to be—
   rendered for want of the Same
   Saml Peale John Carpenter | Commanded it was to the
    & Compa~—— | Sherf of Kent County the Twenty.
                  at | third day of November in the Second
    Patrick Ninance ——       | year of his Lordships Dominion &ca
   that he take Patrick Ninance late of Kent County Planter if he Should
   be found in his Bailywick and him Safe keep So that he have his body
   before his Said Lord Ships Justices of the next Court to be held at our Court-
   house in the Town of Chester in Said County to Answer unto Samue[l]
   Peale John Carpenter & Company Merchts. of a plea of Trespass of the
   Case and that he have then and there the Said writ &ca Att which
   Said next Court vizt. the Eighteenth day of March the Same Yeare
   last mentioned the day of return of Said writ Came Simon Wilmer
   Gent~. high Sherf of Said County and made return thereof in these
   words thereon Endorsed as folls Non Est Inventus pr S:Wilmer Sherf.
   And A Short note being filed when Said writ Issued and a Copy thereof —
   Sent therewith to be left at the last place Defts abode Expressing the
   true Cause of Accon And the Said Plts by Thomas Bowne their attry —
   declare as folls vizt Kent County Ss Patrick Ninance of Kent County Planter
   Stands Attaiched to Answer unto Samuel Peale John Carpenter & Company
   Merchts. of a plea of Trespass of the Case And Whereupon the afd Plt. by Thomas.
   Bowne their attry Complain for that whereas the afd Deft~ in Consideration that
   the afd Plts. the Twenty Eight day of September in the Year of our Lord -
