319 March Court 1717 return of Said writ came Simon Wilmer Gent~ high Sherf of Said County and made return thereof in these words thereon Endorsed as folls vizt. Cepi Corpus pr S Wilmer Sherf And A Decln being filed when Said writ Issued forth and a Copy — thereof Served therewith According to Act of assembly in Such Case made was as folls vizt. Kent County Ss Christopher Young of Kent County Planter alis Dics Christopher Young of Kent County in ye Province of Maryland Planter was Summoned to Answer unto Thomas Rush of ye. County . & Province afsd Planter of a plea that he render to him ye full & just~ Quantity of Six hundred pounds of good Sound Merchantable Leafe— Tobacco in good & Lawfull Seasoned Casque of the value of Six pounds : Sterling money which he unjustly detains &ca. and Whereupon the afd Thomas Rush by Thomas Bowne his attry Saith that Whereas the afd Deft~. the Twenty Seventh day of July in the Year of our Lord Christ~ one Thousand Seven hundred and Seventeen at St. Pauls Parish— in Kent County afd within the Jurisdiciõn of this Court by his certain bill obligatory which he the Said Deft. Sealed with his Seale and as . his deed delivered hereinto Court brought the date whereof is the Same day and Year afd bound himselfe his heires Execrs. or Admrs. to pay or cause to be paid unto the afd Plt. Thomas Rush the afd full and just~ Quantity of Six hundred pounds of good Sound Merchantable Leafe Tobacco in good & Lawfull Seasoned Casque of the afd value of Six pounds Sterling money Convenient in the Said County at or upon the Tenth day of November next Ensuing the date of the Said Bill obligatory Yett the afd Deft~ altho’ often required the afd Quantity of Six hundred pounds of Tobo to the afd Thomas Rush hath not paid or cause to be paid but that to him to render or pay hath hitherto denied & Still doth denie and unjustly — detaine to the damage of him the Said Thomas Rush Tenn pounds Sterling and thereupon he brings Suite &ca TBowne pr Querr pls: Jno Doe & Rd Roe And the Said Deft. being called came And the afd Plt by his afd - Attry And prayd that the Said Deft~ might give Special baile to the afd Accõn which was granted And that he be kept in Safe Custody by the— Sherf of Said County untill he Shall give Special baile as afd. After which James Smith of Langfords Bay in Said County Came into Court and Acknowledged himselfe as Special baile in the afd Accon and doth undertake the payment of the debt afd and Cost thereon Accruing if it Shall happen that the Said Plt Should obtaine Judgment against the Said Deft~ in the Said Accõn of Debt and the Said Deft the Condemnation afd Shall not Satisfie nor himselfe to the Custody of the Sherf of Said County deliver or that the |
