March Court 1717 316 Corn to the proper use and behoofe of him the afd Deft. and that for the payment of the Said ffour Bushells of Indian Corn he the Said Plt reason: :ably deserved the Sume of one hundred and Twenty pounds of Merchantable Tobacco of which the Afd Deft then and there last— mentioned by the afd Plt. had Notice and that Whereas also the Afd — Deft afterwards vizt. the Eighteenth day of October in the Year of our— Lord Christ One Thousand Seven hundred and Seventeen at the parish County and Jurisdiciõn In Consideration that the afd Plt. at the Special Instance and request of the afd Deft had then and there last mentioned paid to divers persons and to the proper use and behoofe of the afd Deft the Sume of Thirteen Shillings Currant money of Maryland and the Sume of One hundred and Seventy Eight pounds of Merchantable Tobacco in an Accot. hereto Annext and in Court Shewn Sett forth upon himselfe Assumed and to the Said Plt. then and there last mentioned— faithfully promised that he the Said Deft the afd Sume of one hundred and Seventy Eight pounds of Tobacco to the afd Plt when thereunto required would well and truly pay and Content and that Whereas also the afd Deft afterwards vizt. the afd Eighteenth day of October in the Year of our Lord Christ one Thousand Seven hundred and — Seventeen at the Parish County & Jurisdicion afd In Consideration that the afd Plt. at the like Speciall Instance and request of the afd Deft had then and there last mentioned Sold and delivered to the afd Deft~. divers goods and Merchandizes in the Accot. Annexed Shewn and to the proper use and behoofe of the afd Deft~ upon himselfe assumed & to the Said Plt then and there last mentioned faithfully promised that he the Said Deft~ So much Merchantable Tobacco as the afd last~ mentioned goods and Merchandizes Sold and delivered as afd at the time of the Sale and delivery thereof at reasonable rates were [Reason:] :ably worth and Amounted to the Said Plt when thereunto required to would well and truly pay and Content And the afd Plt in deed Saith that~ the afd last mentioned Goods and Merchandizes Sold and delivered as afd at the time of the Sale and delivery thereof at reasonable rates were worth and Amounted unto the Sume of Two hundred and — Sixteen pounds of Merchantable Tobacco in manner as in Said Accot. Sett forth of which the afd Deft then and there last mentioned had — Notice Nevertheless the afd Deft. his Severall promises and Assumpti: :ons afd in forme afd. made as to the afd Severall Sumes of Tobacco & money which in the whole Amounts unto the Sume of Nine hundred and - Seventy. Two pounds of Merchantable Tobacco and the Sume of Thirteen Shillings Currant money of Maryland he hath not minded nor in any wise kept But altho’ the Said Deft~ hath paid and Satisfied to him the Said |
