March Court 1717 308 Lord Christ one Thousand Seven hundred and Seventeen at St. Pauls Parish~ in Kent County within the Jurisdiciõn of this Court by his Certain writing obligatory which he the Said Deft Sealed with his Seale and as his deed delivered — hereinto Court brought the date whereof is the Same Day & Year afd granted himselfe holden & firmly bound unto the afd Plt: in the afd full & Just - Sume or Quantity of Three Thousand forty & two pounds of every way good and well Qualified Merchantable Leafe Tobacco in good well Seasoned Cask of of the afd value of ffifteen pounds Sterlign money to be paid to the afd Plt~ when thereunto required Nevertheless the afd Deft altho’ often required the afd Summe of Three Thousand forty & Two pounds of Tobacco to the afd Plt. hath not paid but that to him to render or pay hath altogether denied and Still doth deny & unjustly detain to the Damage of him the afd Plt~. Thirty pounds Sterling money & thereupon he brings Sute &ca. TBowne pr Querr Plegs Jno Doe & Rd Roe - and the afd Plt by his Attry. afd prays that the Deft. may to his Decln. afd Answer And the afd Deft~. being Called came And the afd Plt. by his attry. afd Prays that the Deft. may give Special baile to the afd Accõn~ which was granted And that he be kept in Safe Custody by the Sherf of Said County untill he Shall give Special baile to the afd Accõn~ after which Ebenezar Blackiston of Said County here in Court came. and Acknowledges himselfe as Special baile in the afd Accõn and doth undertake the Payment of the debt afd and Cost thereon Accruing if the afd Plt~. Should obtaine Judgment against the afd Deft in the Said Accon of Debt and the Said Deft the Condemnation afd Shall not~ Satisfie nor himselfe to the Custody of the Sherf of Said County or that the afd Ebenezar Blackiston the body of the Said Richard Marshall— shall not render &ca After which the Said Deft. came into Court and in his proper person appeared to the afd Accõn And Saith that he Cannot gainsay the Accon afd of him the Said Plt. nor but that the writing obligatory above mentioned is his Act and deed And is willing that Judgment Should be entered for the Same & Cost thereon Accruing :: Therefore it is Considered by the Court here vizt. This Twentieth day of March Anno Domini One Thousand Seven hundred and Seventeen That the afd Plt. William Nicholson do recover against the Said Deft Richard Marshall as well the afd Sume of Three Thousand forty and two pounds of Tobacco Debt. as also the Sume of ffour hundred and nine pounds of Tobacco Costs by the afd Plt. about his Sute in this behalfe expended and by the Court here of his assent~ —— adjudged And the Said Deft~. in mercy &ca Jams Smith Clk |
