March Court 1717 304 that the afd. Wm. Glanvill Pltff. recover against the Sd Deft. Samuel Barey as Well the aforesd Sum of fifteen Shillings and nine pence Currant money of Maryland and four hundred and eighty four pounds of Tobacco damages by the aforesd. Pltff. Sustained on Occasion of the Said Deft. his not performing his promises and Assumptions afd. and also the Sum of five hundred & twenty one pounds of Tobacco Cost by the aforesd. Pltff. about his Sute on this behalf expended and by the Court here of his Assent Adjudged And the Said Deft. in Mercy &c James Smith Clk
Planter if he Shall be found in your Bayliwick and him Safe keep So that you have his body before his Said Lordships Justices of the next County Court to be held at our Court house in the Town of Chester in Said County to Answer unto Richard Tilghman of a plea that he render unto him the full and Just Sum of five hundred pounds of good Sound Merchantable Leaf Tobacco Clear of all manner of Trash and Ground Leaves with Cask to Contain the Same of the value of five pounds Sterling money which from him he unjustly detains &c And that he have then & there the Said Writt &c Att which Said next Court viz the eighteenth day of March in the Same Year last mentioned the day of the return of Said Writt Came Simon Wilmer Gent. high Sheriff of Said County and made return thereof in these words thereon Endorsed as follows viz Cepi Corpus pr Simon Wilmer Shriff and a Declaration being filed when Said Writt Issued forth and Copy thereof Served therewith According to Act of Assembly in Such Case made was as followeth viz. Maryland Kent County Ss. Walter King of Kent County Tanner otherwise Called Walter King of Queen Anns County planter was Summoned to Answer him the full and Just Sum of five hundred pounds of good Sound Mer= :chantable leaf Tobacco clear of all manner of Trash and Ground leaves with Cask to Contain the Same of the value of five pounds Sterling money which from him he unjustly detains &c And whereupon the Same Richard Tilghman by James Earle his Attorney Says that whereas the afd. Walter King the twenty Second day of February Anno Domini one thousand Seven hundred and fourteen at Chester New town in Kent County afd. & within the Jurisdiction of this Court by his Certain bill obligatory with the Seal of the Said Walter Sealed Acknowledged himself to owe and Stand Indebted to owe and Stand Indebted to the afd. Richard in the afd. Sum or Quantity of five hundred pounds of Tobacco qualifyed & Conditioned as aforesd wth Cask as aforesaid to Contain the Same as aforesd. to be paid to the Same Richard Convenient in the afd. County of Queen Anns on or before the tenth day of October next ensueing the afd. twenty Second day of Febry Anno Domini one thousand Seven hundred and fourteen afd. and for the performance thereof the afd. Walter did bind himself his heirs Execrs and Adminrs firmly by ye Same bill Nevertheless the afd Walter altho? often requested the aforesd Sum or Quantity of five hundred pounds of Tobacco qualifyed and Conditioned as afd. in Caske as afd. Convenient as afd. of ye afd. value of five pounds Sterling money afd. to the afd. Richard hath not paid but the Same to him to pay hitherto hath |
