   305                               March Court 1717 -
   hath refused and Still doth refuse to the damage of the S^d Richard
   ten pounds Sterling money and therefore he brings this Sute &c and also
   brings into Court the bill Obligatory af^d. whose date is the day & year
   above written which testefyeth the debt af^d &c

   and the afd Plt by his att^ry afd prays that the Deft. afd to his Declⁿ
   afd may Answer the Said Deft being called came And the Said Plt by his
   att^ry that the Said Deft~ may give Speciall baile to the afd.
   Accõn which was granted and that he be kept in Safe Custody by the
   Sherf of Said County untill he Shall give Speciall baile to the afd —
   Accõn    .    .    .    And the Said Deft~ Saith that he cannot gainsay
   the Accõn afd of him the Said Plt. nor but that the writing obliga:
:tory above mentioned in his Act and deed and that he oweth unto the
   Said Plt. the afd Sume of five hundred pounds of Tobacco and is -
   willing that Judgment Should be entered for the Same and Cost~.
   thereon Accruing:    . Therefore it is Considered by the Court~.
   here viz^t. This Twentieth day of March Anno Domini One Thousand
   Seven hundred and Seventeen That the afd Plt Richard Tilghman
   do recover against the afd Deft~ Walter King as well the afd Sume
   of five hundred pounds of Tobacco Debt as also the Sume of Three
   hundred and thirteen pounds of Tobacco Cost by the afd Plt about.
   his Sute in this behalfe Expended and by the Court here of his .
   assent adjudged And the Said Deft~ in mercy &c^a—

Richard Tilghman	\|	Commanded it was to the Sheriff
a^t	\|	of Kent County the twenty third day
Walter King —	\|	of November In the Second year of his
~~~~~~~~~~~~~~~		Lordships Dominion &c That he take Walter

   King . of Kent County Tanner otherwise called Walter King of Queen Anns
   County planter if he Should be found in his Bayliwick and him Safe keep
   So that he have his body before his Said Lordships Justices of the next Court
   to be held at the Court house in the town of Chester in the Said County to
   Answer unto Richard Tilghman Esq^r. of a plea that he render unto him the
   Just Sum of five pounds four Shillings and nine pence Sterling money of Great
   Brittaine which to him he owes and from him he unjustly detains &c And that
   he have then and there the Said Writt &c
   Att which Said next Court viz the eighteenth day of March the Same year
   last mentioned the day of Return of S^d Writt Came Simon Wilmer Gent: high
   Sheriff of S^d County and made Return thereof in these words thereon Endorsed
   as followeth viz Cepi Corpus p^r Simon Wilmer Sheriff. And a Declaration
   being filed when Said Writt Issued and a Copy thereof Served therewith According
   to Act of Assembly in Such Cases made was as followeth viz.
   Kent County Maryland S^st. Walter King of Kent County Tanner otherwise
   called Walter King of Queen Anns County planter was Summoned to Answer
   unto Richard Tilghman Esq^r. of a plea that he render unto him the full and
   Just Sum of five pounds four Shillings and nine pence Sterling money of Great:
   Brittaine which to him he owes and from him he unjustly detains &c
                                                                                                            And
