him Safe keep So that you have his body before his Said Lordships Justices of the next County Court to be held at our Court house in the Town of Chester in Said County to Answer unto William Glanvill of Sd County Inholder of a Plea of Trespass of the Case and that he have then and there the Said Writt &c. Att which Said next Court viz the eighteenth day of March in the Same year Last mentioned the day of return of Said writt Came Simon Wilmer Gent: high Sheriff of Sd County and made return thereof in these words thereon Endorsed as follows viz: Cepi Corpus pr S Wilmer Sherf. And a declaration being filed when Said writt Issued forth and Copy thereof Served therewith According to Act of Assembly in Such Case made was as followeth viz Kent County Ss. Samuell Barey of Kent County Planter Stands Attached to Answer unto Wm: Glanvill of Sd County Inholder of a Plea of Trespass of the Case . And whereupon the aforesd Pltff. by Thomas Bowne his Attorney Complaineth for that Whereas the aforesd Pltff. in the year of our Lord Christ one thousand Seven hundred and thirteen and untill this time at St. Pauls Parish in Kent County within the Jurisdiction of this Court was an Approved Inholder and Ordinary Keeper and as Such Sold Vended and delivered to diverse Inhabitants of this Province and other Persons diverse liquors and found and provided other Suitable Accommodations during which Sd time of ye Sd Pltffs So keeping an Inn or Ordinary viz the twenty nineth day of December in the year of our Lord Christ one thousand Seven hundred and Sixteen at St. Pauls Parish in Kent County within the Jurisdiction of this Court In Consideration that ye Sd Pltff att the Speciall Instance and Request of the aforesd Deft. had then and there Last Sold and delivered to the Sd Deft. and to the proper Use and behoof of the aforesaid Deft. diverse liquors and found and provided other Suitable Accommodations in an Account hereunto Annexed at the Severall Rates and prices in the Sd Account Sett forth in the whole amounting unto the Sum of fifteen Shillings and nine pence Currant Silver money of Maryland upon himself Assumed and to the Said Pltff then and there Last mentioned faithfully promised that he the Sd Deft. aforesd Sum of fifteen Shillings and nine pence Currant Silver money of Maryland to the Said Pltf. when thereunto required would well and truly pay and Content And that whereas also the afores Deft. afterwards viz. the aforesd twenty ninth day of December in the year of our Lord Christ one thousand Seven hundred & Sixteen- at St Pauls parish in Kent County within the Jurisdiction of this Court In Consideration that the afd. Pltff. at the like Special Instance and Request of the aforesd Deft. had then and there last mentioned Sold and delivered to the aforesd Deft. and to the proper Use and behoof of the afd. Deft. diverse liquors and found and provided other Suitable Acco: :modations in an Account hereunto Annexed Specifically Sett forth upon himself Assumed and to the Said Pltff then and there Last mentioned faithfully promised that he the Said Deft. So much Currant money of Maryland as the aforesd last mentioned liquors and other Ordinary Accommodations Sold found and provided as aforesd. were at the time of the Sale finding and providing there at Several Rates and prices worth & Amounted to unto the Said Pltff. when thereunto required would well and truly pay and Content And the aforesd Pltff indeed Say?th that the afores Last mentioned liquors and other Accommodations Sold found and provided as afd. at the time of the Sale finding and providing thereof att reasonable rates and prices were worth and amounted unto the Sum |
