293 March Court. 1717 to Act of Assembly to and for the use of a Certain John Evans unless he the Said Robert Clay by himselfe or his attorney Shall appear and answer unto the Said John Evans in a plea of Trespass upon the Case According to Law and that by good and Lawfull men of . your Bailywick you make known unto the person or persons - hands you make the Same Attachment that he SHee or they be and appear before the Justices our Said Court to be held as afd to. Shew cause if any he She or they have why the Same Goods chattells rights or Creditts So attached in his her or there hands ought not to be Condemned According to Law if to him her or them it Shall Seem meet and how you Shall Execute this writ that you make known unto our Said Justices at the day and place afd and have you then and there this writ witness Nathaniel Hynson Gent. chife Justices of our Said Court this 23d day of Novbr. in the Second Year of our Dominion &ca. Anno Domini 1717 TBowne pr Querr. Jams Smith Clk Att which Said next Court vizt. the Eighteenth day of March the Same yeare last mentioned the day of return of Said writ~ came Simon Wilmer Gent~ high Sherf of Said County and made return thereof in these words thereon endorsed as folls vizt. By vertue of the within writ to me directed I certifie to ye Justices within mentioned that I have Attached of the Goods and Chattells and Creditts of the within named Robert Clay the Sume of five hundred and Seventy pounds of Merchantable Tobacco of the value of Eight pounds Sterling money in the hands of Allexander Williamson Clarke principall Vestry man and his Brethren vestry men of St. Pauls Parish in Kent County afd. and also in the hands of Thomas Ringgold of Said County Gent~. the Summe of Sixteen pounds Sterling money and have the Same here ready to be Condemned According to Law to the use of the within named John Evans and have made known to the persons in whose hands I have made the Same Attachment vizt. to the Said vestry men before James Smith and James Murphey and to the Said Thomas Ringgold before John Ingram & John Maxfield good and Lawfull men of my Bailywick that they and every of them be and appear at the time and place within mentioned to Shew Cause if any they have~ why Condemnation of the Same Should not be According to Law as the within writ Exacteth and requireth Simon Wilmer Sherf~ Att which Said Court came the afd Plt. by Thomas Bowne his attorney and prayd Condemnation According to return of Attachment~ And the - Said vestry men and Thomas Ringgold being Solemly called came and |
