County afd did Committ fornication with a certain man to ye Jurors unknown to ye high displeasure of Almighty God to ye evill and pernicious example- of others & against the form of an Act of Assemb[:] :ley of this Province in Such cases made & provided &ca Johnson pr Dno prpr on the back of the preceeding Indictment was Endorsed as folls vizt. True bill pr me John Evans foureman And the afd Mary being called came & in her proper person appeared to the afd Indictment And plead not guilty & for tryall puts herselfe on ye Country Mary Hussey pr pr . And he who follows for the Lord propry. in like manner Johnson But the afd Mary by Thomas Bowne her attry Saith that the fact Committed by ye afd Mary could Not be within ye Jurisdiccon of this Court by reason that She was the last winter brought out of England as a Servant and the time that She must have Committed the afd fact could not be within ye Jurisdiciõn of this Court on which this Court knowing the Same orders that the Clerk of the Indictments Enter that the afd Indictment be no farther prosecuted : The afd Mr. John Johnson Clerk of the Indictments comes into Court and Saith that by ye directions of the Court the afd Indictment be no farther prosecuted ordered by the Court here that there by Care taken of the Child delivered of the afd Mary . . Mr. John March Saith that he will pay towards the defraying the Charge of Said Child ordered that the Said Mr. John March assumption be entered for what he will pay John Newell of Said County comes into Court and Saith that he will take the afd Child on the Consideration afd and keep it from any charge that may accrew to the County. and Enters into Recognizance with one Surty for the performance thereof The afd John Newell comes into Court and acknow: :ledges himselfe indebted to his Lordship his heires and Successors in the Sume of two Thousand if he do not keep the Same child till it comes of age from any charge that~ may accrew to the County. . likewise comes into Court Edward Davis of this County. and Acknowledges himselfe indebted to his Lordship his heires and Successors in the Sume of Two Thousand five hundred pounds of Tobacco Conditionally that if ye. afd John Newell do not keep the Same child till it comes of age from any charge that may accrew to the County wherewith he acknowledges himselfe Content- on |
