28 June Court 1716 at the parish of St. Pauls in the County afd & within the Jurisdiciõn of this - Court & at divers other days & times as well before as after the fear of God - before her eyes not having did commit fornication with a certain person~ to the Jurors unknown to the high displeasure of Almighty God against the peace &ca. and against the forme of an Act of Assembly of this Province in that case made & provided &ca. Johnson pr Dne Proprietr. on the back of the - preceeding bill of Indictment~ was endorsed as folls viz.t Billa vera pr Simon Wilmer foreman— Thereupon Command was given to the Cunstable of Langfords bay Lower hundred in Kent County the twenty fourth day of March in the first year of — his Lord Ships Dominion &ca. That he take Tabitha Tanner late of Kent County afd Spinster Serv.t to Wm Dicas of Said County Planter if She Should be found in his hundred and her safe keep So that he Carry her before the next Justice of the peace of his Said Lord Ship for the County afd and before the Same Justice to Enter into Recognizance with Such Sureties as the Same Justice Should think fitt for her personall apeparance before the Justices of our next County Court to be held at our Court house in the — Town of Chester in Said County to Answer unto a certain bill of Indictmt~. found by the grand Jury for Committing fornication with a certain man unknown &ca. And that he have then & there the Said precept~. &ca. . . Att which Said next Court vizt the nineteenth day of June Anno Domini One Thousand Seven hundred & Sixteen the day of return of the afd precept came Edward Beck Junior Cunstable of — Langfords bay Lower hundred afd and made return thereof as folls vizt. in all things Served & Executed ————— And now at this Court came the afd Tabitha and in her proper person— appeared to the afd Indictment ordered by the Court here that the afd Tabitha prove who begott her with Child but She denys to do the Same but Saith She cannot deny but that She did Commit fornication and thereby was begott with Child and Submitts to the Court on the premises afd. Therefore it is Considered by the Court here vizt. this twentieth day of June Anno Domini one Thousand Seven hundred & Sixteen— That the afd Tabitha Tanner receive on her bare back thirty one lashes till the blood appeare for Committing fornication as afd according to Act of Assembly in Such cases made &ca. and also pay the Sume of Three— hundred and nine pounds of Tobacco Cost arriseing on the premises It is Considered also by the Court here viz the Same day last mentioned that William Frisby Gent~ high Sherf of Said County take the afd Tabitha Tanner to the Publick whyping post and to receive as in the Judgmt. afd and then to bring her into Court againe After which the Same day last mentioned came the afd Sherf~. |
