November Court 1717 278 to the Same Plt. when thereunto required would well and truly pay and — Content Yet the afd Deft his Severall promises and assumptions afd litle minding but fraudulently intending the Said Plt. in that behalf to deceve and defraud the afd Severall Sumes of Tobacco in the whole amounting- unto the Sume Eighteen hundred and ninety Eight pounds of Tobacco to the Said Plt hath not paid altho’ afterwards vizt. the third day of March~ and often after in the Year of our Lord Christ One Thousand Seven— hundred and Sixteen was at the Parish afd in the County and Jurisdiciõn afd by the Said Plt~ thereto required hath not paid or made Content~ for the Same but that to pay or Content the afd Deft hitherto hath denied and Still doth deny to the damage of him the Said Plt three Thousand pounds of^likeTobacco and thereupon he brings Sute &ca—— TBowne pr Querr pls &ca. Jno Doe & Rd Roe Peter Green Dr. To making one Drugett Coat & vest 180 Ditto one underwastcote 26 Ditto one pr^ofthick Sett breches- 36 Ditto one pr. of Lining breeches 24 Ditto one wastcote Ditto one pr of [Girtleweb?]. breches 40 Ditto one vest 60 Ditto one great Cote 70 Ditto one kersey Cote 80 To one gound for your wife 42 To each of your daughters one goun 70 To a vest and breches for Peter Totall 698 And the afd Plt by his afd attry prays that the Said Deft to his Decln may answer Rule is given to the Said Deft to put in a plea to the afd Accõn in Six hours otherwise Judgmen to be rendered for want of the Same: after which time no plea being put and where by the afd Pltf~ may Remain against the said Deft without defence Therefore it is Considered by the Court here That the afd Plt Peter Walker Recover against the Said Deft Peter Green as well the afd Sume of Six hundred ninety Eight pounds of Tobacco Damages as also the Sume of three hundred Eighty Seven pounds of Tobacco Cost by the afd Plt about his Suite in this behalf Expended and by the Court here of his assent adjudged and that the Said Deft~ be taken into Custody &ca. Doctor Richard Simmonds being an Evide Summoned in the afd Accon proves he attended three days on ye Same ordered by th[e Court] here that the afd Peter Walker pay ninety pounds of Tobacco to the afd Doctor Richard Simmonds for his attendance afd Jams Smith Clk Court adjourns till to morrow morning Eight Cl[ock] |
