277 November Court 1717 given the Plt in like manner . Att which Said next Court viz the nineteenth day of November the - Same day last mentioned Came the Said Plt by Thomas Bowne his - attry and declare as folls vizt. Kent County Ss Peter Green of Kent County afd Planter was attached to Answer unto Peter Walker of a plea of Trespass. upon the Case And Whereupon the afd Plt by Thomas Bowne his attry Complains for that whereas the afd Deft. the Twenty fifth day of Aprill in the Year of our Lord Christ one Thousand Seven hundred and Sixteen at St. Pauls Parish in Kent County within the Jurisdiciõn of this Court In Consideration that the afd Plt. at the Special instance of the afd Deft~ had then and there done diver Services for the afd Deft and to the proper use and behoofe of the afd Deft~ upon himselfe assumed and to the afd Plt. then and there faithfully promised that he the afd — Deft~ so much Tobacco as the afd Services reasonably deserved to the afd Plt. when thereunto afterwards he Should be required would well and truly pay and Content and the afd Plt. indeed Saith that the afd last mentioned Services at the time of the performing of the Same reasonably deserved the Sume of Six hundred and ninety Eight~. pounds of Merchantable Tobacco in the manner as in the Accot~. Sett . hereunto Annexed Sett forth of which the afd Deft then and there had notice . . . And that Wheas also the afd Plt~ and afd Deft vizt. afterwds the thirtieth day of January in the Year of our Lord Christ one Thousand Seven hundred and Sixteen at the Parish afd in the County and Jursidiciõn~ afd had Accounted together of for and Concerning divers Sumes of Tobacco to the Same Plt. by the afd Deft~ before that time owing & unpaid and upon that Accounting the Said Deft was found in Arreage to the afd Plt~. in the Sume of Six hundred pounds of Merchantable Tobacco and so — being found in arrearage the afd Deft in consideration thereof afterwds vizt. the thirtieth day of January in the Year afd at the Parish County &. Jurisdiciõn afd upon himselfe assumed and to the Said Plt~ then and . . there faithfully promised that he the Same Deft the afd Six hundred — pounds of Merchantable Tobacco to the Same Plt~. when thereunto required would well and truly pay and Content and that whereas also the afd Deft~ afterwds vizt. the thirtieth day of January in the Year at the Parish County and Jurisdiciõn afd was Indebted to the Same Pltf in the Sume of Six hundred pounds of Merchantable Tobacco for the like Sume of Tobacco for Services then and there last mentioned done by the afd Plt. for the afd Deft~ and So being thereof indebted the afd Deft~.
