November Court 1717 268 he unjustly detains &ca. And that he have then and there the Said writ &ca. Att which Said next Court vizt. the nineteenth day of November ye. Same Year last mentioned the day of return of Said writ Came Simon Wilmer Gent- high Sherf of Said County and made return thereof in these words thereon Endorsed as folls vizt Cepi Corpus pr SWilmer Sherf. And A Decln being fild which Said writ Issued forth and a Copy thereof Served therewith according to Act of Assembly in Such case made was as folls vizt Maryland Kent County Ss William Furbush of Kent County Planter alis Dics William Furbush of Queen Annes County in the Province abovesd Planter was Summon’d to Answer unto William Thornton of a plea that he render him one likely Young Mare of three or four Years old of the price of . Six pounds Sterling money which from him he unjustly detains &ca. And whereupon the afd Plt by Thomas Bowne his attry Saith that whereas the afd Deft the twentieth day of Mary in- the Year of our Lord Christ one Thousand Seven hundred and nine at St. Pauls Parish in Kent County within the Jurisdiciõn of this Court by his certain bill obligatory which he the Said Deft Sealed with his Seale and as his deed delivered herein to Court brought the date whereof is the Same day and Year afd bound himselfe his heires Executors or Admrs. to pay and deliver unto the Said Plt. the afd one likely Young mare of three or four Years old of the afd price of Six pounds Sterling money to be delivered at the then dwelling plantation of John Linkhorn in Kent County afd at or before the first day of October next Ensuing the date of the Said Bill obligatory Yet the afd Deft altho often required the afd one likely Young Mare to the Said Plt hath not paid or delivered but that to him to pay or deliver the Said Deft hath altogether denied and Yett doth deny and unjustly detain to the damage of him the Said Plt~ twelve pounds Sterling money and thereupon he brings Sute &ca. . TBowne pr Querr pls &ca. Jno Doe & Richd Roe And now at this Court the Said Deft being called came and the Said Plt by his afd attry prays that the Said Deft may give Special baile to the afd Accon which was granted And that he be kept in Safe Custody by the Sherf~ of Said County untill he Shall give Speciall baile as afd . .
