    267                         November Court 1717
   a plea in the afd Accõn in Six hours otherwise Judgment to be-
   rendered for want of the Same after which no plea being put
   in by the afd Plt whereby the Said Deft may Still remain agst~.
   the Said Deft without defence:   The afd Plt. by his attry afd .
   releases all mentioned in the Decln but one Thousand and twelve
   pounds of Tobacco with the Cost Therefore it is Considered by
   the Court here vizt. this Twenty first day of November Anno
   Domini One Thousand Seven hundred and Seventeen~
   That the afd Plt. James Buchanan Recover against the
   Said Deft Thomas Jones as well the afd Sume of one -
   Thousand and twelve pounds of Tobacco Damages as —
   also the Sume of Three hundred Eighty five pounds of~
   Tobacco Cost by the afd Plt about his Suite in this behalfe
   Expended and by the Court here of his assent adjudged and
   that the Said Deft be taken into Custody &ca.
   Whereas the Said Deft having had his tryall in the
   Custody of the Sherf of Said County for want of Speciall
   baile in the afd Accon And now at the prayer of the Plt
   This Court here Commits the Said Deft~ in Execution into
   the Custody of the Sherf of Said County There to remain
   till he Shall Satisfie the Damages & Cost afd

   Town of Chester in Said County to Answer unto William Thornton
   of a plea that he render him one likely Young Mare of three or
   four years old of the price of Six pounds Sterling which from him—
