   Sale and delivery thereof at Reasonable Rates and prices were worth and -
   Amounted to the Sume of One Thousand and Twelve pounds of Merchble
   Tobacco in the manner as in the S[aid] Accot~. Sett forth of which the Said
   Deft~ then and there last mentioned had notice Nevertheless the afd
   Deft his Severall promises and assumptions afd litle minding but fraudu:
  :lently intending him the Said Plt. in that behalf to deceive and defraud
   the afd Severall Summes of Tobacco in the whole amounting to the
   Sume of Two Thousand and Twenty four pounds of Merchantable
   Tobacco to the Said Plt hath not paid altho’ afterwards vizt. the
   Twelfth day of August in the Year afd he the Said Deft was at the
   Parish afd in the County and Jurisdiciþn afd by the Said Plt thereto
   required hath not paid nor made Content for the Same but that
   to pay or Content the Said Deft hitherto hath denied and
   Still doth deney to the damage of him the Said Plt~ four Thousand
   pounds of like Tobacco afd and thereupon he brings Sute &ca

   And now at the Said Court came the Said Plt by Thomas
   Bowne his attry and Prayd the Said Deft to his Decln
   afd might Answer And the Said Deft being called came
   and the afd Plt. by his attry afd Prayd that the Deft~ might
   give Special baile to the above accõn which was granted
   and that he be kept in Safe Custody by the Sherf of Said —
   County untill he Shall give Special baile as afd And a Decln
   being filed as afd . Rule is given to the Said Deft to file
