265 November Court 1717 Justices of the next Court to be held at our Court house in the Town— of Chester in Said County to Answer unto James Buchanan of~ a plea of Trespass upon ye Case and that he have then and there the Said writ &ca . . Att which Said next Court vizt. the nineteenth day of November the Same Year last mentioned the day of return of Said writ came Simon Wilmer Gent high Sherf of Said County and made return thereof in these words thereon endorsed as — folls vizt. Cepi Corpus pr S:Wilmer Sherf And A Decln being filed when Said Writ Issued forth and a Copy thereof Served therewith According to Act of Assembly in Such Case made was as folls vizt. Kent County Ss: Thomas — Jones of Kent County Planter Stands attached to Answer unto James Buchanan of a plea of Trespass upon the Case . . And Whereupon the afd Plt by Thomas Bowne his attry Complains for that whereas - the afd Deft~ the fourth day of August in the Year of our Lord Christ~ one Thousand Seven hundred and Seventeen at St. Pauls Parish in Kent County within ye Jurisdicion of this Court In Consideration that the afd Plt at the Special instance and request of the afd Deft~ had then and there Sold and delivered to the Said Deft to the proper use and behoofe of the afd Deft~ divers goods and Merchandizes in the Account~ hereto Annexed Specifically Sett forth at the Severall Rates & prices in the Said Accot. mentioned Amounting to the Sume of One Thousand and Twelve pounds of Merchantable Tobacco upon himselfe assumed and to the Said Plt then and there faithfully Promised that he the Said Deft~ the afd one Thousand and twelve pounds of Tobacco to the Said Plt. when thereunto required would well and truly pay and Content~ And that Whereas also the afd Deft~ afterwards vizt the afd . fourth day of August in the Year afd at the Parish County and Jurisdicion afd In Consideration that the afd Plt at the like Special instance and request of the afd Deft had then and there last mentioned Sold and delivered to the Said Deft~ to the proper use and behoofe of the afd Deft~ divers goods and Merchandizes in an Accot. hereto Annexed Specifically Sett forth upon himselfe Assumed and to the Said Plt~ then and there last mentioned faithfully Promised that he the Said Deft~ So much Merchantable Tobacco as the afd last mentioned Goods and Marchandises Sold and delivered as afd were at the time of the Sale & delivery thereof at Reasonable rates and prices worth and Amounted to unto the Said Plt~. when thereunto required would well and truly pay and Content~ and the afd Plt. indeed Saith that the afd last mentioned Goods and Merchandizes Sold and delivered as afd at the time of the - Sales |
