   And the afd Plt. by his attry afd Prayd that the afd Deft to his Decln
   afd may Answer . And the afd Deft being called came and the
   Plt by his afd attry prays that the Said Deft may give Special baile
   to the afd Accon which is granted and that he be kept in Safe Custody
   by the Sherf of Said County untill he Shall give Special baile as afd .
   After which Zachariah Mackdaniel of Said County here in Court~.
   cometh and Acknowledgeth himself as Special baile in the afd Accõn
   and doth undertake the payment of the damages afd and Cost accrueing
   if in Case the afd Plt Shall obtaine Judgment against the Said Deft~
   in the Said Accõn of Trespass of the Case And the Said Deft the -
   Condemnation Shall not Satisfie nor himselfe to the Custody of the .
   Sherf of Said County deliver or that the afd Zachariah Mackdaniel
   the body of the Said Thomas Winn Shall not render &ca —
    After which the afd Thomas Winn comes into Court and in his proper
   person appears to the afd Accõn and Saith that he Cannot gainsay
   the accõn afd of him the Said Plt and that he is indebted to the afd Plt.
   the Sume of four hundred Eighty three pounds of Tobacco upon ballance
   and is willing that Judgment Should be entred for the Same and Cost~.
   thereon Accrueing: Therefore it is Considered by the Court her vizt.
   This twenty first day of November Anno Domini One Thousand Seven
   hundred and Seventeen That the afd Plt William Smith Recover
   against the Said Deft. Thomas Winn Junior as well the afd Sume of~
   ffour hundred Eighty Three pounds of Tobacco Damages as also the
   Sume of four hundred Seventy Seven pounds of Tobacco Cost by the
   afd Plt. about his Suite in this behalfe Expended and by the Court~.
   here of his assent adjudged and the Said Deft in mercy &ca
