November Court 1717 262 Thomas Winn had then and there last mentioned Sold & delivered to the aforesd Thomas Winn to the proper Use and behoofe of the aforesd Thomas Winn diverse Liquors and found and provided other Suitable Accommodations in An Account hereto Annexed Specifically Sett forth upon himself Assumed and to the Sd william then and there last mentioned faithfully promised that he the Said Thomas Winn So much good Merchantable Tobacco as the aforesd last mentioned liquors and other Suitable Accommodations Sold found provided and delivered as aforesd were att the time of the Sale finding providing and delivery thereof att reasonable rates and prices were worth And amounted unto unto the Sd William when thereunto required would well and truly pay and Content. And if aforesd William indeed Say’th that the aforesd last mentioned liquors and other Suitable Accommodations Sold found provided & delivered as aforesd att the time of the Sale finding providing and delivery thereof att reasonable Rates and prices were worth and amounted to the Summe of nine hundred and thirty Seven pounds of good Merchantable Tobacco in the manner as in the last Sd Account Sett forth of which ye Sd Thomas Winn by the Sd William then and there last mentioned had Notice Nevertheless the aforesd Thomas Winn his Severall promises & Assumptions aforesd in form aforesd made as to the aforesd Severall Summs of Tobacco in the Sd Declarations mentioned which in the whole amounts unto the Summ of eighteen hundred & Seventy four pounds of good Merchantable Tobacco he hath not minded nor in any wise kept But altho’ he the Said Thomas Winn hath paid and Satisfyed to him the Sd William to the value of four hundred and fifty four pounds of tobacco of the aforesd eighteen hundred and Seventy four pounds of tobacco part Yet the aforesd Thomas Winn his promises and Assumptions as to ye Summ of fourteen hundred and twenty pounds of Tobacco Craftily to deceive and defraud the Sd fourteen hundred and twenty pounds of tobacco the Same Thomas Winn to the Said William hath not paid nor made any Content for the Same Altho’ to pay the Same he the Sd Thomas Winn the twenty Sixth day of Aprile in the year aforesd att the parish County and Jurisdiction aforesd was thereunto required but he ye Said Thomas Winn that to pay to the Sd William hitherto hath denyed & yet denies to the damage of the Sd William three thousand pounds of like tobacco aforesd And thereupon he brings Sute &ca TBowne pr Querr. plds Jno Doe Richd&Roe 1715 Thomas Winn Junr Dr- February 23d to gill rum 6 gill ditto 6 quart Syder 6 - 18 1716 May 2d. to gill rum 6 gill ditto 6 - 12 June 1st gill rum 6 gill ditto 6 gill ditto 6 - 18 gill ditto 6 gill ditto 6 - 18 24 gill rum 6 gill ditto 6 - 24 18 qrt ditto 6 - 18 Club punch 9 qrt Syder 6 - 21 qrt beer 6 qrt ditto 6 - 18 gill rum 6 qrt- Syder 6 24 22d to po Syder 12 qrt ditto 6 18 ( 18 |
