keep So that he have his body before his Said Lordships Justices of the next Court to be held at our Court house in the Town of Chester in Said County to Answer unto William Smith of a plea of Trespass upon the Case and that he have then and there the Said writ &ca. . . Att which Said next Court vizt. the nineteenth day of November the Same Year last mentioned the day of~. return of Said writ came Simon Wilmer Gent~ high Sherf. of Said County and made return thereof in these words thereon- Endorsed as folls vizt. Cepi Corpus pr S:Wilmer Sherf. And a Declaran: being filed when Said writ Issued forth and a Copy thereof Served therewith According to Act of Assembly in Such case made which was as folls vizt. Kent County Ss: Thomas Winn Junr . of Kent County planter Stands Attached to Answer unto William Smith- of a plea of Trespass upon the Case~. And whereupon the aforesd William by Thomas Bowne his Attorney Complains for that whereas the aforesd William in the year of our Lord Christ one thousand Seven hundred and Seventeen and untill this time was att St Pauls Parish in Kent County within the Jurisdiction of this Court an Approved Inholder and Ordinary keeper and a Such Sold vended and delivered to diverse Inhabitants of this Province and other persons diverse liquors and found and provided other Suitable Accommodations dureing which Sd time of the Sd Williams keeping keeping an Inn or Ordinary vizt. the nineteenth day of Aprile in the year of our Lord Christ one thousand Seven hundred and Seventeen att St Pauls Parish in Kent County aforesd within the Jurisdiction of this Court In Consideration the Said William att ye Speciall Instance and request of the Said Thomas Winn had then and there last mentioned Sold and delivered to ye Sd Thomas Winn to the proper Use And behoofe of the Sd Thomas Winn diverse liquors and found and provided other Suitable Accommodations in An Account hereunto Annexed mentioned att the Severall rates and prices in the Said Account Sett forth in the whole amounting unto ye Summ of nine hundred and thirty Seven pounds of good Merchantable Tobacco the Same Thomas Winn upon himself Assumed and to the Said William then and there last mentioned faithfully promised that he the Sd Thomas the aforesd nine hundred and thirty Seven pounds of good Merchantable Tobacco to the Sd William when thereunto required would well and truly pay and Content And that whereas also ye aforesd Thomas Winn afterwards vizt. the aforesd nineteenth day of Aprile in the year aforesd att the parish County and Jurisdiction aforesd.
