   253                                 Novembr. Court 1717
   baile to the afd Accon which was granted and that he be kept in Safe
   Custody by the Sherf of Said County untill he Shall give Special baile to .
   the afd Accon
   After which Ebenezr. Blackiston of Said County here in Court came .
   and Acknowledged himselfe as Special Baile in the afd Accon and
   doth undertake the Payment of the Damages afd and Cost thereon—
   Accrewing if in Case the afd Plt Shall obtaine Judgment against the
   Said Deft in the Said Accõn of Trespass of the Case and the Said Deft~
   the Condemnation Shall not Satisfie nor himselfe to the Custody of~
   the Sherf of Said County deliver or that the afd Ebenez. Blackiston
   the body of the afd John Buly Shall not render &ca ——
   And the afd Deft by John Johnson his Attry appeared to the afd Accõn
   afterwards the Same Accõn was Continued untill the then next Court
   John Evans | Commanded it was to the Sherf of Kent County
           —— | the twenty Second day of August in the Second
             at | Year of his Lordships Dominion &ca. That he
   Robt Clay — | take Robert Clay late of Kent County Mariner if


he Should be found in his Bayliwick and him—
   Safe keep So that he have his body before his Said Lordships Justices
   of the next Court to be held at our Court house in the Town of Chester
   in Said County to Answer unto John Evans Gent Gent~. of a plea of
   Trespass upon ye Case^&caand that he have then and there the Said .
   writ &ca. . .    Att which Said next Court vizt. the nineteenth day
   of November the Same Year afd the day of return of Said writ came
   Simon Wilmer Gent~. high Sherf of Said County and made return-
   thereof in these words thereon Endorsed as folls vizt Non Est Inventus
   pr Simon Wilmer Sherf. And a Short note being filed when Said -
   writ Issued forth and a Copy thereof Sentat therewith according to Act.
   of Assembly to be left &ca. which followeth vizt.
   Jno Evans | The true cause of Action which the Plt hath agst.
        at | ye Deft is for that the Said Deft~ ye Seventh day of .
   Robt. Clay | March Anno Domi one Thousand Seven hundred &


fifteen at Chester New Town in Kent County afd and .
   within the Jurisdiciõn of this Court Reced of the afd Plt tow hhds. of
   Tobo. weighing neat One Thousand ninety & Two pounds of~
   Tobo. of the value of Sixteen pounds Sterling money which Sum of .
   money afd the afd. Deft. Justly owes and is indebted to Said Plt
