251 Novbr. Court 1717 then and there the Said writ &ca. . . Att which Said next Court vizt. the nineteenth day of November the Same Year last mentioned the day of return of Said writ Came Simon Wilmer Gent high Sherf of Said County and made return thereof in these words thereon endorsed as folls vizt: — Cepi Corpus pr SWilmer Sherf. And a Declaration being fild when Said writ Issued forth and a Copy . thereof Served therewith according to Act of Assembly in Such Case made was as folls vizt. Thomas Joce of Kent County Planter alis Dics Thomas Joce of Kent County in ye provence of Maryland was Summoned to answer John— March of a plea that he render him the full and just Sum and Quantity of Eleven hundred and forty pounds of good Sound Marchantable Tobacco — clear of all Manner of Trash and ground Leaves and Cask to conatin the Same of the price and value of Six pounds Sterling money w.ch from— him he unjustly detains &ca. And whereupon the afd Plt. by Thomas — Bowne his attry. Saith that whereas the afd Deft. the tenth day of Decemb.r in the Year of our Lord Christ one Thousand Seven hundred and thirteen~ at S.t Pauls Parish in Kent County afd within the Jurisdiciõn of this Court~. by his certain writing obligatory which he the Said Deft~ Sealed with his Seale and as his deed delivered hereinto Court brought the date whereof is the Same day and Year afd granted himselfe his heires Executors and - Administrators holden and firmly bound to the afd Plt. in the afd full and just Sum and Quantity of Eleven hundred and forty pounds of good Sound — Marchantable Tobacco clear of all manner of Trash and ground Leaves — and cask to contain the Same of the afd price and value of Six pounds Sterling to be paid to ye Said Plt. after ye. tenth day of October next Ensuing ye date . of Said Bill when thereunto required Yett the afd Deft altho’ afterwards vizt. the Second day of Febry and often after in the Year of our Lord Christ one~ thousand Seven hundred and Sixteen he the Said Deft~ was at the Parish- afd in the County and Jurisdiciõn by the Said Plt thereto required the afd Eleven hundred and forty pounds of Tobo. to the Said Plt. hath not paid. nor made Content for the Same but that to pay or Content the afd Deft~. hath hitherto denied and Yet denys and unjustly detains to the damage of . the Said Plt. twelve pounds Sterling money and thereupon he brings Sute &ca. TBowne pr Querr pls &ca Jno Doe & Rd Roe~. And the Said Deft. being called came And the Said Plt by his afd - attry Prayd that the Said Deft might give Speciall baile to the afd — Accon which was granted and that he be kept in Safe Custody by the Sherf of Said County untill he Shall give Specially baile to ye Sd Accon~ after which Robert Dunn of Sd County herein Court came and |
