Court 1717 Att which Said next Court vizt. the nineteenth day of November ye Same Year afd the day of return of Said writ Came Simon Wilmer Gent~ high— Sherf of Said County and made return thereof in these words thereon— endorsed as folls vizt. Cepi Corpus pr S.Wilmer Sherf. And a Declaration being fild when Said writ Issued and a Copy - thereof Served therewith according to Act of Assembly in Such— Case made was as folls vizt. Kent County Ss . Mortough Mohony of Kent~. County Labourer alis Dics Murtough Mahony of Queen Anns County. was Summoned to Answer Charles Seth of Queen Anns County of a plea that he render him the full and just Summe of ffive hundred pounds of~ good Sound Merchantable Leafe Tobacco in Cask to contain the Same of the price and value of ffity Shillings Sterling money which from— him he detains . . . And whereupon the afd Plt. by Thomas — Bowne his attry. saith that whereas the afd Deft the Twenty third day of January in the Year of our Lord Christ one Thousand Seven hundred and — Sixteen at St. Pauls Parish in Queen Anns County within the Jurisdiciõn of this Court by his Certain Bill obligatory which he the Said Deft~ — Sealed with his Seale and as his deed delivered hereinto Court brought the date whereof is the Same day and Year afd bound himselfe to . pay the Said Plt~ the afd ffive hundred pounds of good Sound — Merchantable Leafe Tobacco in Cask to Contain ye Same of the price and value of ffifty Shillings Sterling money Convenient in Queen Anns County at or before the tenth day of November next Ensuing the date of Said Bill obligatory Yet the afd Deft~ altho’ often required the afd Summe of five hundred pounds of Tobacco to the Said Plt hath . not paid but that to him to render or pay the Said Deft~ hath hitherto denied and Yet doth denie to the damage of the Said Plt one Thousand pounds of like Tobacco afd and thereupon he brings Sute &ca. TBowne pr Querr pls &ca Jno Doe & Rd Roe And the afd Plt. not living in the County. by his attry afd prayd he might put in Security that if ye Plt Should be cast in ye Accõn afd ye Deft might~ have his cost which was granted on which the Said Thomas Bowne Saith that he will pay the Cost in the Accõn afd to the afd Deft if the Plt be — Cast in ye Same Accõn and ye Plt Shall not pay it himself The afd Deft being called came and the Said Plt. by his attry afd prayd that the Deft. afd might give Special baile to the afd Accõn which was granted on which Josias Lanham of Said County here in Court came And Acknowledged himselfe or Special baile in the Said Accon and doth undertake the payment of the Debt afd & Cast thereon accrewing if in Case the afd Plt Should obtain Judgmt. |
