   237                                 August Court 1717 .
   having fild no Declⁿ in the Said cause the Court now gives rule to
   the Said Plt~ to putt in his Declⁿ in twenty days after this Court
   adjourns otherwise A Non Suite to be awarded for want thereof-
   Att which Said next Court viz^t this twenty Second day of August the
   Same Year last mentioned Came the Said Deft by James Earle his att^ry
   and the Said Plt having fild no Declⁿ in the Said Cause According to
   rule given last Court The Said Deft by his att^ry afd prays that
   a non Suite may be granted Therefore it is Considered by
   the Court here viz^t. the Same day last mentioned That the Said Plt
   Michael Coulter take nothing by his writ afd but that the Said
   Deft~ go thereof without day and that the Said Plt and his —
   pledges of prosocuteing be in mercy and that the Said Thomas.
   Mercy Recover against the Said Plt Michael Coulter the Sume
   of one hundred and ninety eight pounds of Tobacco Cost by the Said
   Deft about his Suite in this behalf Expended and by the Court-.
   here of his assent adjudged According to the forme of the Statute
   &c^a.
