                                       August Court 1717                                  236 
   five hundred & twelve pds of good Sound Merchantable leef Tobacco
   in Cask to Contain the Same Convenient in Sd County of the value -
   of fifty Shills Sterls money of great Brittain wch. from him unjustly
   detains &ca. and that he have then and there the Said writ
   &ca. .    Att which Said next Court vizt. the twentieth day of .
   November the Same year last mentioned the day of return of Said
   writ Came William Frisby Gent high Sherf of Said County and —
   made return thereof in these words thereon endorsed as folls
   vizt. Cepi Corpus pr Wm Ffrisby Sherf—
      Att which Said Court the Sd Deft being called came and
   the afd Plt by John Johnson his attry prayd that the Said.
   Deft~ might give Special baile to the above Accõn which
   was granted. After which John Wallis and Walter Meeks
   both of this County Came into Court and Acknowledged them:
  :selves as Special baile in the above Accõn and they and
   each of them joyntly and Severally do under take the paymt.
   of the above debt and Cost thereon Accruing if in Case the
   Said Plt. Should obtain Judgment against the Said Deft~
   in the Said Accõn of Debt and the Said Deft~ the Condem:
  :nation afd Should not Satisfie nor himselfe to the Custody
   of the Sherf of Said County deliver or that they the Said John
   Wallis or Walter Meeks or either of them the body of the
   Said Thomas Shall not render &ca
    And the afd Deft by James Earle his attry comes and
   defends the force and injury when &ca. And Saving to —
   himself all and all manner of advantages and Exceptions as
   well to the writ afd as to the Decln of him the Said Plt prayd
   liberty thereof to imparle thereto and to answer at next Court
   which was granted the Same day was given the Plt in like .
   manner
      Att which Said next Court viz the nineteenth day of March the
   Same year last mentioned the Said Cause was Continued untill next
   Court
      Att which Said next Court viz the Eighteenth day of June Anno -
   Domini one Thousand Seven hundred and Seventeen the Said Cause
   being Continued from Court to Court to this Court and the Plt -
