Peter Harwood 100 To Do. agst. Ffredrick 100 To Do agst Eliza. Imbert 100 Totall 2000 And the Said Thomas by John Roberts his attry comes and defends the force & Injury when &ca. and for plea Saith Saith the Plaintife his accõn afd in manner and forme afd against him brought to have - ought not because this Deft~ Saith that he is not guilty of the premises afd in the Plts Declaration above Imposed & of this he for tryal puts himselfe upon the Country Roberts pr Deft~ And the Plt~ in like manner TBowne Command was therefore given to the Sherf of Kent County that he immediately cause to come here twelve &ca. By whom &ca To Recognize &ca. because as well &ca. who neither &ca. And the Sherf. comes and Saith that he hath here ready twelve as by his precept it was Commanded who being Called Likewise came vizt. John Wilson Philip Davis Ebenezar Blackiston Frederick Hanson John Davis Henry Davis James Weyat Samuel Norris Marke Noble William Jones Nicholas Joce John Walls which Jury being duely Elected tryd & Sworn and having heard the Pleadings Evidences and allegations on both Sides do depart from the barr and after Some time do again return and being Called over do appear and being asked whether they are agreed on a verdict do Say they are agreed on a verdict and being asked whether they find the Deft~ guilty or not guilty as above declared do Say that the Deft~ is not guilty as the Plt above hath declared and by John Willson there foreman all So Say the Said Deft~ by his attry afd prays Judgment on ye verdict afd The Plt mvoes in arrest Judgment of the verdict of the Jurors afd but the Same Deft by his attry afd prays that a non Suite may be entred against the Said Plt. Therefore it is Considered by the Court~ here vizt. this twentieth day of June Anno Domini one Thousand Seven hundred and Seventeen That the afd Plt John Johnson take nothing by his writ and Declaration afd but that he and his pledges of Prosecuteing be in mercy And that the Said Deft Thomas Tolley go thereof without day And also That the Said Thomas Tolley do Recover against the Said John Johnson as well the Sume of five hundred Seventy Seven pounds of Tobacco Cost by the afd Deft about his defence in this behalf laid out and Expended According to the forme of the Statute &ca.
