June Court 1717 212 the Town of Chester in Said County to Answer unto Jno Johnson of a plea that he render unto him the Sum of Two Thousand pounds of Tobacco of the value of Sixteen pounds Sterling which from him he unjustly detains &ca. and that he have then and there the Said writ &ca. . Att which Said next Court vizt. the twentieth day of November the Same year last mentioned the day of return of Said writ Came William Frisby Gent high Sherrife of Said County and made return thereof in these words thereon endorsed as folls vizt. Cepi Corpus pr Wm Ffrisby Sherf and the Said Deft in his proper person appeared to the Said accõn and prayd liberty thereof to imparle thereto and to answer at~ next Court which was granted the Same day was given the Plt also Att which Said next Court vizt the nineteenth day of March the Same year last mentioned the Same Cause was Continued untill next Court Att which Said next Court vizt. the eighteenth day of June Anno Domini one Thousand Seven hundred and Seventeen the Said cause Standing for tryall Came the Said Plt by Thomas Bowne his attry and the Said Deft by John Roberts his attry and the Said Plt by his Said Attry declare as folls viz Maryland Kent County Ss Thomas Tolley late of Kent County Gent was Summoned to answer unto Jno Johnson of a plea that he render unto him the Sum of two Thousand pounds of Tobacco of the value of Sixteen pounds Sterling which from him he unjustly detains &ca. . And whereupon the Said John by Thomas Bowne his attry Says that whereas in an by an Act of Assembly of our late Sovereign Lady Queen Anno at the port of Annopolis in An arun = :dell County the Twenty Sixth day of Aprill in the third year of her Said Majesties Reigne held for the Province of Maryland it Stands ordained & enacted that from & after the Publication thereof any person or persons whatsoever intend to depart this Province Should first give notice of his her or there intended departure by Setting up his her or there name or names at the Secretarys office the full Space of three months that if in So Setting up his or there respective name or names as afd it Should be then Lawfull for the Governour Keeper of the great Seale or Secretary of this Province for the time being to Sign a pass to any Such person or persons to depart this Province for which the Party Should pay to the person Signing the Same the Sum of two Shillings & Six pence Sterling & if any person or persons upon any Sudden or emergent occation Should be necessitated to depart this province not having Sett up his her or their names at the Secretarys office as afd then Such Person or Persons giving good & Sufficient Securety to discharge & pay all debts and Acco s wt. Soever Should be due and owing from the Said person to any^ofthe Inhabitants of this Province then the person or persons Should have a pass as afd and |
