                                         June Court 1717                                    208 
   as folls vizt Cepi Corpus pr Wm Ffrisby Sher.   But a Declaration being
   fild when Said writ Issued forth and a Copy thereof Served therewith—
   according to Act of Assembly in Such cases made was as folls vizt Kent
   County Maryland Ss Richard Mason of Kent County Planter alis Dics Richd
   Mason of Kent County in the Province of Maryland Planter was Summoned
   to Answer unto Philemon Lloyd of Queen Annes County in ye afd Province
   Esquier of a plea that he render to him ye full & Just Sume of Three Thou:
  :sand Eighty Six pounds of good Sound Merchantable leafe Tobacco &
   Caske of ye value of twelve pounds Seventeen Shills & two pence
   Sterling money which from him he unjustly detains &ca. And whereupon
   the afd Plt. by Thomas Bowne his attry Saith that whereas the afd
   Deft~ ye twenty fourth day of July Anno Domini Seventeen hundred
   fourteen at S.t Pauls Parish in Kent County afd within the Jurisdiciõn
   of this Court by his certain writing obligatory which the Said Deft~
   Sealed with his Seale and as his deed delivered hereinto Court brought
   the date whereof is the Same day and Year afd Granted himselfe holden
   and firmly bound unto the afd Plt in the afd full and Just Sume of
   Three Thousand Eighty Six pounds of good Sound Merchantable leafe
   Tob.o & Cask of ye afd value of twelve pounds Seventeen Shillings & two .
   pence Sterling money to be paid to the Same Plt when thereunto
   required Yet the afd Deft altho’ often required the afd Three Thou =
  :sand Eighty Six pounds of Tobo to the Said Plt hath not rendered
   but the Same hitherto to render hath denied & yet doth deny and —
   unjustly doth detain to the damage of the Said Plt twenty pounds .
   Sterling money and thereupon he brings Suite &ca TBowne pr qr.
   pledges &ca. John Doe & Richd Roe . . And at the Said Court
   the Said Deft~ being called came and the Said Plt by his afd attry -
   prays that the Said Deft may give Special baile to the above Accon
   which is granted after which Harmanus Schee of Said County -
   here in Court came and acknowledged himselfe Special baile in the
   above Accõn and undertakes for the Said Deft the payment of the
   Debt afd and Cost accruing if in Case the afd Plt Shall obtaine Judgmt.
   in the Said Accon of Debt and the Deft the Condemnation Shall not
   Satisfie nor himselfe to the Custody of the Sherrife of Said County —
   deliver or that the Said Harmanus Schee the body of the Said Richd
   Shall not render &ca.    After which the Said Richard in his —
   proper person appeared to the above Accõn and Saith that he
   Cannot gainsay the Accõn afd of him the Said Plt nor but that the
   writing obligatory above mentioned is his act and deed and that
