March Court 1716 196 baile in the afd Accõn and doth undertake the payment of the Debt afd and Cost thereon accruing if in Case the afd Deft~ Should be Cast in the accõn afd and the Condemnation Should not Satisfie nor himselfe to the Custody of the Sherrife of Said County deliver or that the afd Arthur Miller the body of the Said Deft~ Shall not render &ca. And the Said Deft~ by John Johnson his attry appeard to the above Accõn . . After which the afd Deft in his proper person came into Cou[rt] and Saith that he Cannot gainsay the Accõn afd nor but that the — writing obligatory above mentioned is his act and deed and is — willing that Judgment Shall be entred for the Sume of Eight Thousand three hundred Seventy two pounds of Tobacco the debt (in the Decln — above mentioned ) and Cost thereon accrueing : Therefore it is Considered by the Court here vizt. this twenty third day of March—— Anno Domini one Thousand Seven hundred and Sixteen That~ the afd Plt. Hans Hanson do recover against the Said Defendant~ Joseph Milby as well the afd Sume of Eight Thousand Three—— hundred Seventy two pounds of Tobacco Debt as also the Sume of four hundred and Three pounds of Tobacco Cost by the afd Plt about his Suite in this behalfe Expended and by the Court here of his assent~ adjudged and the Said Deft in mercy &ca ~ Obligation fild —— Jams Smith Clk And the afd Plt comes into Court in his proper person and Saith he hath Received in part of the above obligation in the above Declaration mentioned the Sume of Seven Thousand three — hundred and twenty pounds of Tobacco —— after which comes into Court Coll Edward Scott and Saith that~ In behalfe of the afd Deft he will pay the afd Plt the ballance of the Judgment afd being one Thousand and fifty two pounds of— Tobacco and the whole Cost in the Judgment afd —— Daniel Ferril being an Evidence Summoned to this Court to give Evidence in a certain cause Depending William Ringgold at the Suite of William Woodland The Same proves he attended two days on— the Same Account Ordered by this Court that the afd William~ Ringgold pay the Same Daniel Ferril Sixty pounds of Tobacco for his attendance afd and The Sume to be allowed the Said William Ringgold in the bill of Cost— Petit Jury discharged |
