195 March Court 1716 him the full and Just Sume of Eight Thousand three hundred Seaventy two pounds of good Sound Merchantable leaf Tobacco & Cask of ye value . of thirty four pounds Seventeen Shillings and Eight pence Sterling money which he unjustly detains &ca. and that he have then and there - the Said writ &ca— Att which Said next Court viz the nineteenth day of. March the Same year last mentioned the day of return of Said writ~ came William Frisby Gent high Sherf of Said County and made — return thereof in these words thereon endorsed as folls vizt Cepi Corpus pr Wm Ffrisby Shr. But a Decln being fild when Said writ~ Issued forth and a Copy thereof Served therewith according to Act~ of Assembly in Such Case made was as folls vizt. Kent County Maryland Ss Joseph Milby of Kent County Planter alis Dics Joseph Milby of Kent- County Plantr. was Summoned to Answer unto Hans Hanson of a plea that he render to him the full and Just Sume of Eight Thousand Three hundred Seventy two pounds of good Sound Merchantable leafe — Tobacco & Cask of ye value of thrity four pounds Seventeen Shillings and Eight pence Sterling money w.ch he unjustly detains &ca. And Whereupon the afd Plt by Thomas Bowne his attry Saith that whereas the afd Deft the Nineteenth day of November Anno Domi: :ni Seventeen hundred and fifteen at S.t Pauls Parish in Kent County afd within the Jurisdiciõn of this Court by his Certain writing obliga: :tory which the Said Deft Sealed with his Seale and as his deed — delivered here into Court brought the date whereof is the Same day & year afd Granted himselfe holden and firmly bound unto the afd Plt in the afd full and Just Sume of Eight Thousand Three hundred Seventy Two pounds of good Sound Merchantable leafe Tobacco & Cask of ye afd value of thirty four pounds Seventeen—— Shillings and Eight pence Sterling money to be paid the Same Plt~ when thereunto required Yet the afd Deft- altho’ often required the afd Eight Thousand Three hundred Seventy two pounds of Tobacco— to the Said Plt~ hath not rendered but the Same hitherto to render hath denied & yet doth deny and unjustly detain to the damage of the Said Plt Tenn pounds Sterling money and thereupon he brings Sute . &ca. TBowne pr Querr pls &ca. John Doe & Richard Roe — Att which Said Court the afd Deft being Called Came and the Said Plt by his attorney afd prayd the Said Deft~ might give Special baile to the above Accõn which was granted and that he be kept in Safe Custody by the Sherrf of Said County untill he Shall— give Special baile to the afd Accõn After which Comes into Court — Arthur Miller of Said County and Acknowledges himselfe as Special baile |
