183 March Court 1716 have then and there the Said writ &ca ——— Att which Said next Court viz the Twentieth day of November the Same year last mentioned the day of return of Said writ Came William Frisby Gent high Sherf of Said County and made return thereof in these words thereon endorsed as folls vizt. Cepi Corpus pr Wm Ffrisby Sherf — And a Declaration being fild when Said writ Issued worth and a Copy thereof Served therewith according to Act of assembly in Such cases made was as folls viz.t Kent County Ss John Burk of Kent County Planter alis Dics John Burk Planter was Summoned to Answer unto Josiah Crouch Adm.r of all & Singular ye Rights & Credits which were of Anthony Knowlman~ late of Sd County deceased at ye time of his death who died Intestate as tis Said of a plea that he render him five hundred & fifty Seven pounds of Tobacco in Cask of ye. value of forty Six Shillings & five pence Sterling money which he unjustly detains &c.a And Whereupon the Said Pltf . by Thomas Bowne his attry Saith that whereas y.e afd Deft by his certain Bill obligatory made Sealed as the deed of ye Said Deft~ to the Said Anthony the Second day of 9.ber Anno Domini Seventeen hundred & thirteen in ye lifetime of the Said Anthony at Kent County afd in the Jurisdiciõn of this Court delivered which with the Seale of ye Said Deft the Same Deft in ye life time of ye Said Anthony Signed hereinto Court brought bound himselfe to pay or Cause to be paid unto the afd Anthony the afd five hundred & fifty — Seven pounds of Tobacco in Cask of the afd value of forty Six Shillings and five pence Sterling money in the afd County at upon or before ye tenth day of 8.ber next Ensuing ye date afd Yet the afd Deft altho’ often demanded the afd five hundred & fifty Seven pounds of Tobacco to the afd Anthony in his life time or to the afd Plt after his the Said Anthonys death to which the Said Deft Administracõn of all and Singular ye goods and Chattells Rights & Credits which were of ye afd Anthony at the time of his death hath— been lawfully Committed hath not paid or caused to be paid but that to pay to the Said Anthony in his life time and to the Said Plt~ after the death of the Said Anthony hitherto hath altogether denied and to the Said Plt Yet to render doth deny and unjustly detain to the damage of the Said Plt ninety Shillings Sterling money and in delay of the Administration afd and thereupon he brings Suite &ca. and brings hereinto Court the letters Administracõn afd which Testifie &ca — TBowne pr qt. pls &ca. Jno Doe & Richd Roe —— And the afd Deft being called Came and the Sd Plt by his attry afd prayd that the Sd Deft might give Special baile to the afd Accõn which was — granted And that he be kept in Safe Custody by the Sherf of Said County untill he Should give Special Baile to the above accõn Att which Said next Court vizt this Twenty third day of March Anno - Domini one Thousand Seven hundred and Sixteen The following baile piece was delivered which folls vizt.
