     179                                   March Court 1716
   may Still remain against the Said Deft wthout defence Therefore it
   is Considered by the Court here viz this Twenty third day of March —
   the Same year last mentioned That the afd Plt John Valliant do —
   recover against the Said Deft Philip Eilbeck as well the Sume of Two
   pounds fifteen Shillings and nine pence Curr.t money Damages —
   as also the Sume of Three hundred and fourteen pounds of Tobacco.
   Cost by the afd Plt. about his Suite in this behalfe Expended and by the
   Court here of his assent adjudged and that the Said Deft be taken into
   Custody

   John Jones — | afd Plt by Thomas Bowne his attry Complains for that

   and fifteen and in the year of our Lord Seventeen hundred and Sixteen in Kent
   County afd within the Jurisdicion of this Court was an approved ordinary keeper
   and during which Said time of the Said Plts So keeping ordinary vizt. the twelfth day
   of 9.ber Anno Domini Seventeen hundred and Sixteen at St. pauls parish in Kent
   County afd within ye Jurisdiciõn of this Court the Said Deft In Consideration the
   Said Plt at the Special Instance and request of the Said Deft~ had then and there
   last mentioned vended Sold & delivered unto the Said Deft~ to his the Said —
   Defts use & behoof divers Liquors and other ordinary Accomodations at~.
   certain rates & prices in an Account hereto annexed Specifically Shewn—
   amounting in ye whole to Eighteen hundred and fifteen pounds of Merchant:
  :able Tobacco upon himselfe assumed and to the Said Plt~ then and there last
   mentioned faithfully promised that he ye Said Deft the afd Eighteen hundred and
   fifteen pounds of Merchantable Tobacco to the Said Plt. when thereunto afterwds
   required would well and truly pay & Content and that whereas also the afd Deft~
   afterwards viz the afd twelfth day of 9.ber Anno Domini Seventeen hundred & -
   Sixteen at the parish afd in the County afd within the Jurisdiciõn afd In Con:
  :sideration the afd Plt at the like Special Instance & request of the afd .
   Deft had then and there last mentioned as ordinary keeper afd vended
   Sold and delivered to the Same Deft~ to his the Said Defts proper use divers
   Liquors and other ordinary Accomodations in an Account hereto annexed
   Set forth upon himselfe assumed and to the Said Plt then and there last
