March Court 1716 178 Curr.t money of America of which the Said Phillip then and there had notice and whereas the Said Philip the first day of Aprill Anno Domini one Thousand Seven— hundred and Sixteen at the Parish County & Jurisdiciõn afd was indebted unto him the Said John Valliant in the Sume of two hundred and Sixty pounds of Tobacco of the value of one pound one Shillg and eight pence Currant money of America for So much Tobacco by him the Said Phillip for the proper use & behoofe of - him the Said John Valliant then and there had and received and being So. indebted he the Said Philip in Consideration thereof did upon himselfe assume & to the Said John Valliant then and there last Said faithfully promised that he the Said Philip the Said Sume of two hundred and Sixty pounds of Tobacco to the Said John Valliant when he should be afterwards thereunto required would well & truly content and pay Yet nevertheless the afd Philip his pro: :mises and assumptions afd in forme afd made little minding or regarding but plotting & fraudulently intending him the Said John Valliant in this behalfe craftily & Subtilly to deceive and defraud the Said Severall Sums of money amounting in the whole to the Sume of two pounds fifteen Shillings & nine pence to the Said John Valliant (altho’. to do the Same the Said Phillip by the Said John Valliant the first day of June in the year last Said at the - Parish County & Jurisdiciõn afd was thereto required) hath not pay but to pay hath altoger refused & Still doth refuse wherefore he Says he is worse and hath damage to the Value of Tenn pounds Currant money of America and thereupon he brings Suite &ca. Deft to put in a plea to the Said Accõn by the last day of the Court otherwise Judgment to be rendered for want of the Same after which the time afd being out and no plea put in on which the Said Plt may |
