his Said Lordships Justices of the next Court to be held at our Court house in the Town of Chester in Said County to Answer unto Jno. Valiant of a plea of Trespass upon the Case and that he have then and there the Said writ &ca. Att which Said next Court vizt the twentieth day of November the Same year last mentioned the day of Return of Said writ Came William Frisby Gent- high Sherrife of Said County and made return thereof in these words thereon Endorsed as folls vizt. Cepi Corpus pr Wm Ffrisby Sherf Att which Said Court the Said Plt~ by John Johnson his attorney prays that he be taken as Surety for the Plt to pay Cost in the Said Accõn if he Should be non Suited Which was granted the Same John Johnson in Court acknowledges himself as Surety for the Said Plt. and doth under :take the payment of all Cost if the afd Deft Shall appear to the afd Accõn and Non Suite the Plt in the Same if the Plt afd pay not the Same himselfe And the Plt afd by his attry afd prays that the Said Deft may give Special baile to the above Accõn which is granted and that the Sherf of Said County keep the Said Philip Eilbeck in Safe Custody untill the Shall give Special baile to the above Accon after which the Said Plt~ by his attry afd Puts in his Declaration which is as folls vizt. Kent County Maryland Ss Phillip Eilbeck late of Kent County Glazier was attaiched to answer unto John Valliant of a plea of Trespass on the Case and whereupon the Said Phillp the- first day of Aprill in the year of our Lord one Thousand Seven hundred and fifteen at the Parish of S.t Pauls in the County afd and within the Jurisdiciõn of this Court in Consideration that the afd John Valiant keeping a publick house of Entertainmt. did at the Special Instance & request of the Said Philip then and there found and provided for the Said Philip divers liquors & other accomodations as by the Acot. hereto annexed may more particularly appear did upon himselfe and to the Said John Valliant then and there faithfully promised that he the Said Philip all Such Such Sums or Sumes of money as the Said Liquors and other accomodations at the time of the Sale & delivery thereof unto the Said John Valliant when he Should be afterward thereto required would well & truly content & pay and the Said John Valliant in fact Saith that the Said Liquors & other accomodations at the time of the Sale & delivery thereof unto the Said Philip were reasonably worth to him the Said John Valiiant the Sume of one pound fourteen Shillings & one penny Currt. |
