March Court 1716 176 afd Barbara after the death of the Said Thomas Jackson the afd Six hundred fifty and Seven pounds of good Sound Merchantable Tobacco on or before the afd first day of March which to him he the Said Philip on or before the Same day ought to have paid according to the forme & effect of the afd Bill obligatory by which Accõn hath accrued to the Said Thomas Jackson in his lifetime and to the afd Barbara after the death of the afd Thomas Jackson to Exact and have of the afd Philip the afd one Thousand three hundred and fourteen pounds of Tobacco (of the afd value of Tenn pounds Sterling money) Yet the afd Philip altho’ often required the afd one Thousand three hundred & fourteen pounds of Tobacco to the afd Thomas Jackson in his lifetime or to the Said Barabara after his the Said Thomas Jacksons death hath not rendered but that to the Said Thomas Jackson in his lifetime and to the Said Barbara after the Said Thomas Jacksons death to render hath denied and yet to render doth deny & unjustly detain in delay of ye Executing the Testament afd and to the damage of the Said Barbara fifteen pounds - Sterling money and thereupon She brings Suite &ca. and brings hereinto Court the letters Testamentary &ca which Testifie &ca. TBowne pr Querr plegs &ca Jno& Doe Rchd Roe And the afd Plt~. by her afd attry prays that the Said Deft to the declaration afd may Answer And this Court doth give rule to the afd Defendant- to put a plea to the afd Declaration by the last day of the Court otherwise Judgment to be rendered for want of the Same And the time that was given to the afd Deft to put in his plea being out whereby the Plt may remain against the Said Deft. undefended- Therefore it is Considered by the Court here vizt. This Twenty third day of March Anno Domini one Thousand Seven hundred and Sixteen That the afd Plt. Barbara Jackson Executrix of the last will and Testament of Thomas Jackson deceased Recover against the afd Defendant Philip Eilbeck as well the afd Summe of one Thousand three hundred and fourteen pounds of Tobacco Debt afd as also the Sume of Three hundred and forty Seven pounds of Tobacco Cost by the afd Plt about her Suite in this behalfe Expended and by the Court here of his assent adjudged and that the Said Deft be taken into .
