175 March Court 1716 found in his Bailywick & him safe keep So that he have his body before his Said Lord Ships Justices of the next Court to be held at our Court house in the Town of Chester in Said County to Answer unto Barbara Jackson Execrx. of ye Last will and Testament of Thomas Jackson late of Queen Annes County Innholder deceased of a plea that he render to her the Sume of one Thousand Three hundred and - fourteen pounds of good Sound Merchantable Tobacco of ye value of Tenn pounds Sterling money which he unjustly detains &ca. And that he have then and there the Said writ &ca. Att which Said next Court vizt. the twentieth day of November the Same Year last mentioned the day of return of Said writ Came William Frisby Gent high Sherrife of Said County and made return thereof in these words thereon Endorsed as folls vizt. Cepi Corpus pr Wm Ffrisby Sherf. Att which Said Court the Said Deft being called Came and the afd Plt~ by Tho Bowne her Attorney prays that the Said Deft may give Special baile to the above Accõn which was granted and that he be kept in Safe Custody by the Sherf of Said County untill he Shall give Special baile to the afd Accõn Att which Said next Court vizt the nineteenth day of March the Same year afd Came the afd Plt by her afd attry declares as folls viz Kent County Ss Philip Eilbeck of Kent County Glazier alis Dics Philip Eilbeck Glazier was Summoned to Answer unto Barbara Jackson Execrx. of ye last will and Testament of Thomas Jackson late of Queen Annes County Innholder deceased of a plea that he render to her the Sume of one Thousand Three hundred and fourteen pounds of good Sound Merchantable Tobacco of ye value of Tenn pounds Sterling money which he unjustly detains &ca. And whereupon the Said Barbara by Thomas Bowne her attorney Saith that whereas the afd Philip the . Seventh day of 9ber Anno Domini Seventeen hundred and fifteen at St~. Pauls Parish in Kent County afd within the Jurisdiciõn of this Court by . his Certain Bill obligatory which the Said Philip in the life time of the Said Thomas Jackson Sealed with his Seale and as his decd delivered hereinto Court brought the date whereof is the Same day & year afd Bound himselfe his heires Execrs. & Admrs. in the afd Sume of one Thousand three hundred & fourteen pounds of good Sound Merchantable Tobacco of the afd value of Tenn pounds Sterling money for the true payment of the full & just Quantity of Six hundred fifty Seven pounds of good Sound Merchant: :able Tobacco of ye value of five pounds Sterling money to the afd Thomas Jackson on or before the first day of March next Ensuing the date of the afd Bill and the afd Barbara in deed Saith that the afd Philip hath not paid to the afd Thomas Jackson in his lifetime or to the afd |
