165 March Court 1716 untill he Shall give Special baile to the afd Accon Att which Said next Court viz the Twentieth day of Novembr. the Same year afd. And the Said Plt by his afd Attry declares as folls vizt K.t County Ss Philip Eilbeck of Kent County Glazier was attaiched to answer unto James Crook of a plea of Trespass on ye Case And whereupon the Same James Crook by James Earle his attry complains for that whereas ye afd James Crooke ye Eleaventh day [of] Novemb.r Anno Domi One Thousand Seven hundred and fourteen and untill the fourth day of Janry one Thousand Seven hundred and fourteen afd was at ye Citty of Annapolis (that is to Say) at Chester new Town in Kent County afd and within ye Jurisdiciõn of this Court an approved Innholder and ordinary keeper and as Such Sold vended & delivered to divers ye Inhabitants of this Province & others Sundry Liquors and found provided & delivered other Suitable accomodations during which Said time of the Sd James So keeping Inn & ordry viz ye fourth day of Janry Anno Domi one thousand Seven hundred & fourteen afd at the Citty afd (viz) in Kent County & within the Jurisidiciõn afd ye Said Deft in Consideration the Said Plt. at ye Special Instance & request of the Said Deft had then and there last Said Vended Sold & delivered to the Said Deft~ to the Said Defts use Suitable . & Convenient accomodations at a Certain rate & value as by an Accot. ready here in Court to be produced may more plainly and at large appear Amountin to ye Sum of three pounds Sixteen Shillings Currt. money of this Province of Maryland upon himself assumed and to the Said James Crooke then and there last Said faithfully promised yt he ye Sd Philip So much Currt. money of the afd Province as ye afd liquors vended Sold & delivered Accomods. Suitable & Convenient as afd at ye time of the Sale and delivery & accomodateing thereof at reasonable rates and values were worth & amounted to unto ye Said James when thereunto afterwards required would well & truly pay and Content and ye afd James Crook indeed Saith that ye afd Liquors and accomodations as afd Sold vended & delivered as afd at the time of the Sale & delivery thereof at reasonable rates & values were worth and Amounted unto the afd Sume of three pounds Sixteen Shillings Currt. money afd in manner as in the above mentioned accot. Set forth of which the Said Philip then and there last mentioned had notice and altho’ ye Said Philip afterwds that is to Say the twenty Seventh day of December Anno Domini One thousand Seven hundred & fourteen afd at the Cutty afd vizt. in Kent County within ye Jurisdiciõn afd paid to the Said James ye Sume of Sixteen Shillings and Six pence Currt. money afd part of the afd Sum of three pounds Sixteen Shillings - Currt. money afd Nevertheless the afd Philip his promise and assumption afd as to the Sum of two pounds nineteen Shillings and - Six |
