   155                                March Court 1716
   promise and assumption afd Little minding but fraudulently Intend:
  :ing the Said Cornelius in that behalf to deceive and defraud the
   afd Eleaven hundred and Twenty five pounds of Tobacco to the Said
   Cornelius altho’ afterwards viz the Seventh day of 8ber and often
   after in the year of our Lord Christ Seventeen hundred and fifteen
   he was at the Parish in Kent County afd within ye Jurisdiciõn of~
   this Court thereto demanded hath not paid nor made Content
   therefore but the Same to pay or Content the Said Laughlin—
   hitherto hath denied And Yet denys to the damage of the Said
   Cornelius two Thousand pounds of Tobacco and thereupon—
   he brings Suite &ca. and brings hereinto Court the afd Bill
   or note which Testifies &ca. TBowne pr Querr pls &ca John Doe
   and Richd Roe    and the afd Plt by his attry afd prayd -
   that the Said Deft to his declaration afd might answer &ca.
   And the afd Deft by James Earle his attry appeared to the
   above accõn and prayd liberty thereof to imparle thereto
   and to answer at next Court which was granted the Same day
   was given the plt also ——
      Att which Said next Court viz the nineteenth day of June
   Anno Domi one Thousand Seven hundred and Sixteen—
   the Said Cause was Continued untill next Court in Course &ca
      Att which Said next Court vizt the twenty first day of August
   the Same Year last mentioned the Same cause was Continued
   untill the then next Court
    Att which Said next Court vizt. the Twentieth- day of
   November the Same year last mentioned the Same—
   cause was Continued untill the then next Court
      Att which Said next Court vizt. this Twenty Second day -
   of March the Same year last mentioned the Said Cause Standing
   for tryal Came the Said plt by his afd attry and the Said Deft~
   by his Said attry who puts in his plea as folls vizt.
      And the afd Laughlin Flinn by James Earle his attry —
   comes and defends the force & injury when &ca. and Says that
   he did not assume upon himselfe in Such manner and forme
   as the afd Cornelius in his Decln afd agst. him hath declared
   and of this he puts himselfe upon ye Country James Earle pr Deft~
      And Plt in like manner   TBowne pr Querr.
