     147                                March Court 1716
   render to him Nineteen hundred Seventy & three pounds of Merchant:
  :able Tobacco of the value of Tenn pounds Sterling money which he —
   unjustly detains &ca.   And Whereupon the afd Plt by Thomas Bowne
   his attry Saith that whereas the afd Deft the Seventeenth day of May .
   Anno Domi one Thousand Seven hundred and Sixteen at S.t Paules —
   Parish in Kent County afd in ye Jurisdiciõn of this Court by his Certain
   writing obligatory which the Said Deft Sealed with his Seale and
   as his deed delivered hereinto Court brought the date whereof is the
   Same day and Year afd Granted himselfe holden and firmly bounden
   to the afd Plt by ye name of Gilbert Higginson Merchant in Great
   Brittain in the afd Sum of Nineteen hundred Seventy & three pounds
   of Tobacco qualified as afd of the afd value of Tenn pounds Sterling -
   money to be paid to the Said Plt when thereunto required hath
   not paid nor made any Content for the Same but that to pay or —
   Content the Said Deft hath hitherto denyed and yet denys and
   unjustly detains to the damage of the Said Plt Three Thousand —
   pounds of Tobacco and thereupon he brings Suite &ca. TBowne
   pr Querr pls &ca. John Doe & Richd Roe ——
     And the Said Deft~ being called came and the Said Plt—
   by his attry afd prays that the Said Deft may give Special
   baile to the afd Accõn which is granted and that he be kept
   in Safe Custody by the Sherf of Said County untill he Shall give
   Special baile as afd After which John Williams of Said County
   here in Court cometh and acknowledgeth himselfe as Special baile
   in the afd Accõn and doth undertake for the afd Deft~ the
   payment of the Debt afd and Cost thereon accruing if in
   case the Said Plt Shall obtaine Judgment against the Said Deft~
   in the Said Accõn of Debt~ and the Condemnation afd Shall not
   Satisfie nor himselfe to the Custody of the Sherf of Said County
   deliver or that the afd John Williams the body of the Said —
   Deft~ Shall not render &ca. .
      Att which Said Court Came the Said Deft~ in his proper
   person and appeared to the above Accõn and Saith that he
   Cannot gainsay the Accõn afd of him the Said Plt nor but~.
   that the writing obligatory above mentioned is his act and
   deed and that he oweth unto the Said plt as above mentioned
