   he have thereof Execution against the Said John Berry According to
   Act of Assembly in Such Case made &ca —— The afd Plt giveing
   Surety as the Act of assembly in Such Cases doth require &ca after
   which comes into Court Mr. Marmaduke Tilden of Said County And
   acknowledges himself Surety for the Said Plt that is to Say if ye
   afd Deft by himselfe or his attry Shall come in and appear to
   the original Accon within a Year and day and make it appear
   that the Said Plt is Satisfied the demand afd or otherwise Shall in
   Court discompt the debt afd or any part that then he Shall make
   restitution of the Tobo afd Attached or the value thereof

   be found in his Bailywick and him safe keep So that he have his body -
   before his Said Lord Ships Justices in Court now Sitting at the Court house
   in the Town of Chester in Said County to answer unto Gilbert Higginson of
   a plea that he render to him Nineteen hundred Seventy three pounds of
   Merchantable Tobacco of the value of tenn pounds Sterling money which
   he unjustly detains &ca. And that he have then and there the Said writ
   &ca.   Att which Said Court vizt. Cepi Corpus pr Wm Ffrisby Sherf
   And A Decln being filed in Said Accon which folls vizt Kent County
