   141                              March Court 1716
   altho’ the afd David hath paid to the Said James the Sum of four
   hundred pounds of Tobo of the afd Sixteen hundred eighty & eight~
   pounds of Tobo part Yet the afd David as to the Sume of Twelve
   hundred eighty & eight pounds of Tobacco Residue fraudulently —
   Intending ye Said James in that behalfe to deceive & defraud the
   Said Twelve hundred Eighty & Eight pounds of Tob.o to ye Said —
   James altho’ afterwards vizt the third day of March and often after
   in the year afd he the Said David was at the Parish afd in the
   County and Jurisdiciõn afd by the Said James thereunto required
   hath not paid nor made Content for ye Same but that to pay or
   Content the Said David hitherto hath denied & Yet denys to ye.

   And now at this Court the day afd mentioned The Said Deft~.
   being called Came And the Said Plt by Thomas Bowne his
   attry prays the Said Deft may give Spl baile wch was granted
   after which Mr Henry Lowe Junr. of Said County comes into Court~
   and acknowledges himselfe as Special baile in the above accõn
   and doth undertake for the Said Deft the payment of the damages
   afd and Cost accruing if it Should happen that the Said Plt Shall
   obtain Judgment against the Said Deft in the Said Accõn of—
   Trespass upon the Case and the Said Deft~ the Condemnation—
   afd Shall not Satisfie nor himselfe to the Custody of the Sherf.
